Eligibility:
1.    The “Monster Energy® Supercross Giveaway” (the “Promotion”) is only open to natural persons who are legal residents of, and physically located within Canada, and are over the age of majority in the province or territory in which they reside at the time of entry and possess a valid passport with at least six (6) months validity from the end of the Promotion Period (as defined below), except employees, representatives and agents, and members of their immediate families (i.e., parents, spouses, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Monster Energy Canada ULC. (“Monster” or “Sponsor”), Feld Motor Sports, Inc., Sponsor’s SMS provider: GOcxm Inc. (“GOcxm” or “Sponsor’s SMS Provider”), the fulfillment administrator: LPi Group Inc. (“LPi” or “Administrator”), and their respective affiliated companies, parent companies and subsidiaries (“Affiliates”), participating Promotion partners, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution or production of the Promotion, or fulfillment of the prizes (collectively, the “Promotion Entities”).

Agreement to Official Rules
3.    By participating in the Promotion, entrant fully and unconditionally agrees to, and accepts, these official rules (the “Official Rules”) and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion.

Promotion Period
4.    The Promotion begins at 12:01 AM Eastern Time (“ET”), on September 1, 2024 and ends at 11:59 PM ET, on October 31, 2024 (the “Promotion Period”). GOcxm’s computer is the official time-keeping device for this Promotion. Eastern Time means either Eastern Standard Time or Eastern Daylight Savings Time depending on which time is in effect on the date in question.

How to Enter the Promotion
6.    There are two (2) methods of Promotion entry:

(i)    No Purchase Necessary Entry. To participate in the Promotion without a purchase, during the Promotion Period, submit an original hand-written essay by sending an email with a scan or legible photo of the essay to monsterfulfillment@lpi-group.com that includes: (a) the email subject line: “Monster Energy® Supercross Giveaway”; (b) a three hundred (300) word or more, unique and original hand-written essay on “Why I want to win a Supercross Experience” (an “Essay”); and (c) your first name, last name, telephone number, complete mailing address, and date of birth. Each Promotion entrant who submits an approved Essay submission will be emailed one (1) alphanumeric CODE for the Promotion, while supplies last. Follow Step 2 below to enter and be eligible for a chance to win a Prize. No photocopies of a previously submitted Essay with hand-edits or computer-made will be accepted. Each Essay must be an original and submitted as above. Any Essays determined to be copies or are fraudulent in any way will disqualify all entries into the Promotion by that person. Sponsor’s decisions are final.

(ii)    Entering the Promotion. To enter, complete the following steps:

Step 1: Purchase any 473 mL Monster Energy® product with a silver tab (see Appendix A), and save the promotional CODE under the tab; Participating Products may not be available in all locations and markets at all times during the Promotion Period;
Step 2: Text “SUPERCROSS” to 87878 to receive a Promotion link OR scan the QR code printed on point-of-sale materials found in stores and follow these steps. Regular text messaging rates, airtime, data, and carrier charges may apply;
Step 3: You will be directed to complete your account set up (your cell number, name, postal code, date of birth, and email address) or sign-in to your existing account and accept the promotional terms & conditions. Promotion entrants will be required to consent to receiving electronic messages, and the collection, use, storage and disclosure, of their personal information by Sponsor and GOcxm for the purposes of this Promotion via text message to complete their entry. Entrants will also be asked to consent to the use, storage and disclosure of their personal information by the Sponsor and its Affiliates to provide entrants with marketing materials. Entrants may subsequently withdraw their consent to receive such marketing materials, as provided herein, at any time without affecting their chances of winning;
Step 4: Enter the CODE(s) from under the Participating Product’s silver tab (or in the case of No Purchase Necessary Entry, the alphanumeric CODE provided for an approved Essay);
Step 5: Select one (1) of four (4) Instant Prize options (as defined in Rule 11) to allocate an entry towards that Prize pool; 
Step 6: An instant “scratch and win” screen will appear, move your finger across the “scratch here” on the screen to see if you are a potential Instant Prize winner (subject to correctly answering a skill-testing question). Instant Prize winners will be directed to complete a claim form;
Step 7: Each CODE entered during the Promotion Period will also automatically receive one (1) entry into the Promotion for the Grand Prize. There is no limit to entering the Promotion multiple times per day, by any method, as long as each entry is original.

7.    Regular text messaging rates, airtime, data, and carrier charges may apply; no other costs or other obligation will be incurred, by entering the Promotion. These Official Rules can be found at: https://monsterenergyrules.com/supercross
8.    All entries must be received during the Promotion Period. Entries which are incomplete, late, lost or irregular in any way, or sent by an unauthorized method are void and will not be eligible or accepted at the time of the draw. Only one (1) mobile phone number may be used by any one person to participate in this Promotion. Any personal information submitted will be used, stored and disclosed for the purposes of administering this Promotion, and for with consent, promotional purposes in accordance with Sponsor’s privacy statement. See full details regarding Privacy below. 
9.    Entries will only be accepted as described herein and will not be accepted by any other means. Each potential winner will be identified as the authorized account holder of the mobile phone number used to enter the Promotion.

Bonus CODES 
10.    Entrants can also earn two (2) bonus CODES when they refer an individual with whom they have a family relationship or personal relationship with to the Promotion, provided that individual registers for this Promotion and logs into their account.

For these purposes, a “family relationship” means the relationship between you and the individual to whom you are sending the message, are related to one another through a marriage, common-law partnership or any legal parent-child relationship, and those individuals have had direct, voluntary, two-way communication.

A “personal relationship” means a relationship between the sender and the referred individual, where those individuals have had direct, voluntary, two-way communication and it would be reasonable to conclude that they have a personal relationship. The GIC Regulations set out a non-exhaustive list of factors that should be used to determine whether there is a personal relationship (e.g., the sharing of interests, experiences, opinions, and information evidenced in the communications; the frequency of the communication, etc.).

Upon registration and logging in, the referred individual will earn two (2) bonus CODES. Limit of one (1) set of bonus CODES allocated per user during the Promotion.

To obtain this bonus, Entrants must log into the Promotion website and share the unique referral URL found within the “my profile” section. The referral URL can be shared with individuals with whom you have a family relationship or personal relationship you think would be interested in learning about this Promotion and would not consider this to be spam. When the referred individual clicks on the unique URL, registers for the Promotion and logs in, you will each receive two (2) bonus CODES to use towards an Instant Prize entry, and the Grand Prize entry. Bonus CODES will be automatically added to the referred individuals and referrer’s account. If you share this unique URL through social channels, please ensure that you are compliant with all applicable Terms of Use. Any share of this unique URL through social channels must include #contest/sweepstakes as part of your post.

Prizes
11.    Grand Prize: There is one (1) “Grand Prize” available to be won. 
The Grand Prize includes: (a) round-trip, economy class airfare tickets for the Grand Prize winner and one (1) guest from a major airport near the Grand Prize winner's residence in Canada (as selected by Sponsor in its sole discretion) to Anaheim, California, USA; (b) three (3) nights’ standard hotel accommodations (based on double occupancy); (c) two (2), California, USA; and (d) Two Thousand Canadian Dollars spending cash ($2000.00 CAD). The approximate retail value (“ARV”) of the Grand Prize is $10,000.00 CAD. *Exact event and travel dates to be confirmed by Sponsor. Grand Prize winner and Grand Prize winner’s guest each must possess a valid passport with at least six (6) months validity from the end of the Promotion Period.

Instant Prizes: There are fifty-six (56) “Instant Prizes” available to be won. 
Each Instant Prize is one (1) of four (4) different merchandise items. 
•    Six (6) Monster Energy® helmets; ARV $610.00 CAD.
•    Thirty (30) Monster Energy® travelling bags; ARV $300.00 CAD.
•    Fifteen (15) Monster Energy® apparel items; ARV $100.00 CAD.
•    Five (5) cooler bundles, including: one (1) Monster Energy® cooler and a one (1) year supply of Monster Energy® products. *One (1) year supply of Monster Energy® products is defined as thirty-one (31) 458-473mL twelve (12) packs in one (1) Monster Energy® flavour chosen by the potential winner(s), subject to availability; ARV $1010.00 CAD.

There is a limit of three (3) Instant Prize(s) awarded per user. Instant Prize winners are eligible for the Grand Prize draw.

The ARV of the Grand Prize may vary depending on the Grand Prize winner's residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Ground transportation is not included, the Grand Prize winner and guest are responsible to arrange a car rental or shuttle. Sponsor is not responsible for, and the Grand Prize winner will not receive, the difference between the actual value of the Grand Prize at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or materials. Specific travel arrangements and all Prize details not specified herein will be made and determined in Sponsor’s sole discretion. Travel must originate from and end at the same airport. It is the Grand Prize winner’s and guest’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed Prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. The Grand Prize winner will be required to provide a credit card at time of accommodation check-in to cover incidentals. Grand Prize winner and guest ticket holders will be required to comply with all applicable venue rules and regulations at the time of redemption. In the event of venue or event closure, cancellation, or postponement, ticket terms and conditions will govern and the Promotion Entities will have no further obligation to winner.

12.    From time to time herein, the Grand Prize and Instant Prizes may be individually referred to as a “Prize” and collectively, the “Prizes”. Prize suppliers are independent parties over which Sponsor does not exercise any control. Sponsor is not responsible for the acts or omissions of these suppliers nor does it assume responsibility for any warranty, claims, losses, damages, costs, expenses, delays or loss of enjoyment to any Prize winner.
13.    Merchandise items, styles, colors and sizes are subject to availability and may be substituted without advance notice. Please allow approximately twelve (12) weeks for delivery after you claim your Instant Prize. Sponsor and Prize suppliers are not responsible for any packages that are not deliverable, or returned, due to any novel coronavirus (COVID-19) pandemic related issues, delays, or cancellations, or if the incorrect shipping address was entered, these items will not be resent.
14.    Each Prize must be accepted as awarded, and may not be assigned, substituted, or redeemed for cash value. In case of the unavailability of a Prize, or any component of, Sponsor reserves the right to substitute the Prize, or component of, for one of equal or greater value. All other Prize details not specified in these Official Rules will be determined in the Sponsor’s sole discretion.

Grand Prize Draw
15.    A random draw from all eligible entries for the Grand Prize will be made by Sponsor’s SMS Provider, GOcxm, on November 4, 2024. The Grand Prize draw will take place at GOcxm, 116 Spadina Ave, Suite 100, Toronto, ON, M5V 2K6, at approximately 3:00 PM ET, to select the potential Grand Prize winner.

Odds
16.    The odds of winning an Instant Prize will depend on the time of each entry scratch played. Prior to the Promotion Period, GOcxm will randomly pre-select a series of winning times during the Promotion Period using a computer algorithm. Each winning time is associated with a single Instant Prize. The time of scratch will determine whether a person is eligible to win an Instant Prize. The first person to scratch at a winning time (or, if no scratch is recorded at a winning time, the first person to scratch after that winning time) is a potential winner eligible to win the Instant Prize associated with that time. The odds of winning the Grand Prize in this Promotion depends on the total number of valid entries received during the Promotion Period.

Requirements of Potential Winner(s)
17.    To be declared a potential Prize winner, the selected entrant who is eligible for such Prize will be required to correctly answer unaided (mechanical or otherwise), a time-limited mathematical skill-testing question at a predetermined mutually convenient time. Following the draw described herein, the selected entrant will be contacted by email or by phone at the number provided by the entrant. If the selected entrant cannot be reached personally without leaving a message by telephone within two (2) business days of the first phone call made and after a minimum of two (2) attempts by a Sponsor representative, and if such selected entrant fails to execute and return a declaration and release form (waiver) within two (2) business days from the date of receipt thereof, or if they do not otherwise comply with these Official Rules, their entry will be forfeited and the next selected entrant drawn will be contacted on the third (3rd) day and such process may be repeated at the discretion of the Sponsor. 
18.    As a condition of winning and accepting receipt of any Prize, each Prize winner, and the Grand Prize winner’s guest, must sign a declaration and release (waiver), in the form requested by Sponsor confirming compliance with these Official Rules, acceptance of a Prize as awarded, and releasing Sponsor, its Affiliates, and all the Promotion Entities.

Privacy
19.    Monster and its Affiliates, and the agents of each, may, from time to time, collect, use and disclose the personal information you provided in connection with this Promotion for the purposes of administering the Promotion and Prize fulfillment. For further information about Monster's and its Affiliates’ use of personal information, please visit Monster's website and review the Privacy Policy and Terms of Use accessible at https://www.monsterenergy.com/en-ca/privacy-policy/ and https://www.monsterenergy.com/en-ca/terms-of-use/ respectively.  
20.    Winners consent to the Sponsors’ use of their names, photographs, cities, voices, images and/or statements, related to their Prize for publicity purposes in any manner or media including the Internet, at any time, in perpetuity, without compensation or notice. The opportunity to receive other communications about the Sponsor’s or its Affiliates products, promotions and other promotional offers may be provided by the Sponsors.
21.    Monster will treat all personal information in accordance with relevant privacy laws. It is the intention of Monster that all personal information provided in connection with the Promotion be kept confidential and used, stored, and disclosed only for the purposes outlined herein or as permitted in Monster's Terms of Use and Privacy Policy.
22.    By entering this Promotion and providing their consent, Promotion entrants agree to the use of their personal information for the purposes described herein or in Monster's Terms of Use and Privacy Policy. Promotion entrants may withdraw this consent at any time by emailing privacy@monsterenergy.com.

General Rules
23.    By participating and/or entering this Promotion, entrants agree to comply with these Official Rules and with the decisions of Sponsor and the Administrator as they relate thereto.
24.    By entering this Promotion, each Prize winner and Grand Prize winner’s guest agrees to sign a waiver, as described above. In addition, each Prize winner agrees to the use of their name, place of residence and image in any publicity carried out by Sponsor without compensation. 
25.    By accepting any Prize in connection with this Promotion, each winner agrees to release, remise and forever discharge the Sponsor, its Affiliates, and the Promotion Entities from and against any and all claims, liabilities, costs, injuries, losses or damages of any kind incurred in connection with the delivery, installation, use and consumption of any Prize.
26.    Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, CODES and release documents, or for any problems or failures. Sponsor is not responsible for any incorrect or inaccurate information, or by any technical or human error, which may occur in the processing of entries in the Promotion. If, for any reason, the Promotion is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion or cause it to not comply with any applicable law having jurisdiction over Sponsor, then, subject to regulatory approval when required, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion without notice.
27.    Sponsor reserves the right to disqualify any entrant who it finds to be in violation of these Official Rules or tampering with the Promotion process. Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Any attempt by anyone to deliberately undermine the legitimate operation of this Promotion is in violation of criminal and civil laws and Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
28.    All decisions of Sponsor in connection with this Promotion are final and binding in all respects. The Prizes must be accepted as awarded. The Prizes are non-transferable.
29.    All entries become the property of Sponsor and will not be returned.
30.    This Promotion and the terms and conditions contained in these Official Rules, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein.
31.    This Promotion is subject to all applicable federal, provincial and municipal laws and is void where prohibited.
32.    All disputes, disagreements, controversies, questions or claims arising out of or relating to this Promotion, including, without limitation, with respect to its execution, validity, application, interpretation, performance, breach, termination or enforcement (“Disputes”), except where prohibited by law, shall be (a) resolved individually, without resort to any form of class action, and (b) shall be determined by a sole Arbitrator (the “Arbitrator”) under the Arbitration Act, 1991 (Ontario) (the “Act”). The resolution of Disputes pursuant to this section shall be final and binding upon the parties, and there shall be no appeal therefrom, including, without limitation, any appeal to a court on a question of law, a question of fact or a question of mixed fact and law. In addition: (a) section 7(2) of the Act will not apply to the arbitration; (b) unless the parties otherwise agree, the Arbitrator will be appointed by a judge of the Superior Court of Justice of Ontario on the application of any party on notice to all the other parties. No individual shall be appointed as Arbitrator unless they agree in writing to be bound by the provisions of this Article; (c) the arbitration shall take place in the City of Toronto unless otherwise agreed in writing by the parties; (d) subject to the Act, the Arbitrator may conduct the arbitration in the manner the Arbitrator considers appropriate; (e) the language to be used in the arbitration shall be English; (f) within seven (7) calendar days after appointment the arbitrator shall set the hearing date, which shall be within ninety (90) calendar days after the filing date of the demand for arbitration unless a later date is required for a good cause shown. The parties agree to a mutual exchange of relevant documents and the taking of up to a maximum of five (5) depositions by each party to last no more than two (2) calendar days in aggregate for each party; (g) the parties desire that any Dispute should be conducted in strict confidence and that there shall be no disclosure to any person of the existence of the Dispute or any aspect of the Dispute except as is necessary for the resolution of the Dispute; and (h) the Arbitrator shall have the right to determine all questions of law and jurisdiction, including questions as to whether a claim is arbitral, and shall have the right to grant legal and equitable relief including injunctive relief and the right to grant permanent and interim injunctive relief, and final and interim damages awards. The Arbitrator shall also have the discretion to award costs, including reasonable legal fees and expenses, reasonable expert's fees and expenses, reasonable witnesses' fees and expenses pre-award and post-award interest and costs of the arbitration.
33.    The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Monster’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, privacy policy or terms of use on a website and/or the provisions of these Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Monster’s sole and absolute discretion.
34.    The Claw Icon and all Monster Energy® trademarks are owned by Monster Energy Company and/or its parent, subsidiary, and affiliated companies. Other trademarks appearing are the property of their respective owners.  
35.    “Feld Motor Sports, Inc.” names, logos, and/or materials are used for the purposes of promotion only and does not suggest or imply sponsorship of this Promotion.
