شروط وأحكام العرض

الرّجاء قراءة الشّروط والأحكام ("الشروط") بعناية. بمشاركتك في العرض الخاص (كما يتمّ تعريفه أدناه)، فإنّك توافق/ين على التّقيّد بهذه الشّروط. يجدر بك أيضًا أن تقرأ/ي سياسة الخصوصيّة على الموقع www.monsterenergy.com والتي تفسّر كيف سنستخدم البيانات التي تقدّمها/ينها لنا بمشاركتك في هذا العرض الخاص.

1.    وفقًا للأحكام في الفقرة 4 أدناه، فإنّ هذا العرض الخاص ("العرض") متاح لجميع الأشخاص في سنّ الثّامنة عشرة (18) فما فوق المقيمين في إسرائيل.  
2.    هذ العرض بتنظيم وتفعيل شركةMonster Energy EuropeLimited  وعنوانها 7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD ، في المملكة المُتّحدة ("مونستر إنرجي").  
3.    يتمّ تنظيم هذا العرض من خلال الموقع الالكتروني www.monsterenergy.com/mclaren_il ("الموقع") ويتمّ التّرويج له من خلال موادّ ترويجيّة في متاجر مشاركة في إسرائيل التي تبيع عبوات من منتجات العلامة التّجاريّة مونستر إنرجي (كلّ منها هو "متجر").  
4.    لا يُسمح بالمشاركة في العرض لأيّ موظّف أو لأيّ فرد من أفراد عائلة أيّ موظّف في مونستر إنرجي، أو إحدى الشّركات التّابعة لها، أو مقاوليها الفرعيّين، أو وكلائها، أو أوصيائها، أو أيّ شخص آخر مرتبط بالعرض مهنيًّا.  
5.    بمشاركته في العرض بمقتضى هذه الشّروط، يوافق كلّ مُشارك ("أنت"، "لك"، "مشارك")على التّقيّد بهذه الشّروط وبقرار(ات) مونستر إنرجي، التي سيكون قرارها نهائيًّا، بكلّ الأمور المتعلّقة بالعرض. لن تشارك مونستر إنرجي في أيّ مراسلات إضافيّة.  
6.    جميع الأزمنة والتّواريخ المُحدّدة في هذه الشّروط تشير إلى الأزمنة والتواريخ في إسرائيل. في حال وجود أي نزاع حول وقت أو تاريخ أي مشاركة مقدمة، يكون قرار Monster Energy نهائيًا.

عمليّة المشاركة والاختيار

7.    إثبات الشراء مطلوب للمشاركة في هذا العرض الترويجي، ويتضمن ذلك: (1) الاحتفاظ بعبوات مشروب مونستر إنرجي (3 عبوات بحجم 500 مل) التي تم شراؤها للمشاركة في العرض الترويجي وتقديمها إلى مونستر إنرجي عند الطلب؛ و(2) يُطلب من كل مشترك تحميل صورة شخصية له (ملف JPEG لا يتجاوز حجمه 5 ميجابايت) على الموقع الإلكتروني مع عبوات مشروب مونستر إنرجي الثلاثة (3) بحجم 500 مل" ("صورة العلبة") ("إثبات الشراء").  
8.    تقتصر المشاركات على مشاركة واحدة (1) لكل إيصال.  
9.    تاريخ بداية هذا العرض هو 01/08/2025 عند السّاعة 00:00 ("تاريخ البداية") وتاريخ إغلاق هذا العرض هو 31/08/2025 عند السّاعة 23:59 ("تاريخ النّهاية").  
10.    يُمكن للمشاركين المشاركة بواسطة:  
10.1.  التّصرّف بموجب هذه الشّروط؛  
10.2.  شراء ثلاث (3) عبوات سعة 500 مل من منتج مونستر إنيرجي من أحد المتاجر والاحتفاظ بها/الالتزام بمتطلبات إثبات الشراء؛ و  
10.3. إدخال ما يلي على الموقع الإلكتروني:  
10.4. تقديم تفاصيلهم وفقًا للإرشادات الموضحة على الموقع (وهي الاسم الكامل، السّنّ، عنوان السّكن، رقم الهاتف، وعنوان البريد الإلكترونيّ)؛ و  
10.5. الإجابة عن السؤال التالي بما لا يزيد عن ثلاثين (30) كلمة عن السّؤال: "من هو سائقك المفضل في فريق مكلارين للفورمولا 1 ولماذا؟"("الجواب").  
11.    كلّ مُشارك يُرسل مشاركته كما تنصّ الفقرة 10 (يشار إليها معًا باسم"المشاركات المؤهّلة"، أويُشار إلى كلّ منها باسم "المشارَكة المؤهّلة") سوف يدخل في عمليّة الاختيار (المُحدّدة أدناه).  
12.    سيتعاون معًا أفراد الطاقم المُكوّن من مندوب واحد (1) على الأقل من مونستر إنرجي وحكم مستقلّ واحد (1) (يشكّلون معًا "اللجنة")، خلال عشرة (10) أيّام من تاريخ النّهاية ("تاريخ الاختيار")، لتحديد الفائز التالي ("الفائز"):  
12.1. فائز واحد (1) بالجائزة (كما هو محدد أدناه) تكون أجابته الأكثر توافقًا مع معاييرالاختيار (كما هو محدد أدناه)  
13. تُحدد اللجنة الفائز بناءً على الجواب الذي يُبرز الرد الأكثر إبداعية وابتكارية، ويعكس براعة المتسابق، والفهم الوثيق لبطولة  Monster Energy®، والتوظيف الأفضل للمفردات والاستخدام الأمثل لأسلوب الكتابة ("معايير الاختيار").  
14. تتأكد اللجنة من صلاحية المشاركات بحسب هذه الشروط، والحكم على "المُشاركّات المؤهلة" بحسب "معايير الاختبار"، وتوزيع الجائزة (على النحو المُحدد أدناه)، على الفائز، ("عملية الاختيار").

الجوائز والمتطلّبات

15. يفوز الفائز برحلة لمدة ست (6) ليالٍ لشخصيْن اثنيْن (2) إلى أبو ظبي، الولايات المتحدة الأمريكية في المدة بين 2025.12.02 و2025.12.08 ("الرحلة")، على النحو الذي تحدده مونستر إنرجي وفقًا لتقديرها المطلق، لتشمل ما يلي ("الرحلة"):  
15.1. لقاء واحد (1) مع فريق مونستر إنيرجي ومكلارين.  
15.2. الإقامة لمدة ست (6) ليالٍ لشخصيْن اثنيْن (2) في غرفة مزدوجة بفندق من فئة الثلاث (3) نجوم على الأقل؛ يتم اختيار الفندق من قبل مونستر إنرجي وفقًا لتقديرها المطلق، رهنًا بالتوافر ("الفندق")؛  
15.3. تذاكر العودة على الدرجة الاقتصادية لشخصيْن اثنيْن (2) من مطار في إسرائيل إلى مطار في الولايات المتحدة الأمريكية، يتم اختيارهما من قبل مونستر إنرجي ("مطار الوجهة المقصودة")، وتحدد مونستر إنرجي مواقع المطارات وتواريخ الرحلات الجوية ومواعيدها وفقًا لتقديرها الكامل؛ والانتقال ذهابًا وإيابًا لشخصيْن اثنيْن (2) في وسائل نقل اقتصادية من مطار الوجهة المقصودة إلى الفندق، وتحدد مونستر إنرجي الأوقات والتواريخ ووسائل النقل وفقًا لتقديرها المطلق، رهناً بالتوافر؛  
16. الفائز وشخص واحد (1) فقط يختاره الفائز ("الفائز")، هما من يحق لهما الاستفادة من الجائزة. يجب أن توافق مونستر إنرجي على الشخص المختار، وأن يكون عمره فوق ثمانية عشر (18) عامًا، وأن يكون مقيمًا في إسرائيل. يجب أن يحمل الرابح والشخص المختار جوازات سفر سارية المفعول لا تنتهي صلاحيتها قبل 26.06.30 للاستفادة من الجائزة.  
17. قبل إعلان الفائز واستلام الجائزة، سيُطلب من الفائز المحتمل والشخص الذي اختاره القيام بما يلي:  
17.1. تزويد مونستر إنرجي بإثبات الشراء الخاص بالفائز المحتمل، بالشكل الذي تحدده مونستر إنيرجي؛  
17.2. إثبات تلبيته لمعايير المُشاركة المُحدّدة في هذه الشّروط، ومن ضمنها، دون حصر، إثبات السّنّ والسّكن والهويّة، وقد يتضمّن ذلك، دون حصر، إثبات ساري المفعول لمكان السّكن، رخصة القيادة، جواز السّفر أو هويّة تُصدرها الحكومة، قبل استلام جائزته؛ و  
17.3. توقيع مصادقة خطّيّة تؤكّد أهليّته وتوقيع إعفاء من المسؤوليّة قبل تسليم الجائزة إليه، نسخة من المصادقة مرفقة في الملحق أ أدناه. يُمكن الحصول على نسخة من المصادقة والإعفاء ذوي الصّلة بواسطة إرسال طلب إلى Gadi.Scheafer@Monsterenergy.com.  
الإخفاق في إرسال هذه المعلومات إلى مونستر إنرجي خلال فترة زمنيّة معقولة تُحدّدها مونستر إنرجي قد يؤدّي إلى خسارة الفائز المُحتَمَل جائزته وإلى اختيار مونستر إنرجي لمشارَكة مؤهّلة أخرى بأقرب فرصة معقولة وممكنة بعدئذٍ.  
18. تجنبًا للشك، يتحمل الفائز وحده جميعا التكاليف المرتبطة بالجائزة، بما في ذلك على سبيل المثال لا الحصر، الضرائب، والتأمين الصحي الساري للسفر، وتأشيرة السفر (إن وجدت)، والنقل، والمعدات، والإعاشة، وأي وسائل ترفيه، وأي شيء يتعلق بالجائزة لم يتم إدراجه وتحديده في تعريف الجائزة أعلاه. تعتمد إقامة الجائزة على أساس الغرفة فقط، وسوف يتحمل الفائز والشخص المنتخب تكلفة جميع الأطعمة والمشروبات المستهلكة في الفندق وأي مكان آخر، غير الُمدرجة والمنصوص عليها تحديدًا في تعريف الجائزة، وكذلك جميع الرسوم الإضافية للغرفة.  
19. تقع على عاتق الفائز الرئيسي مسؤولية تقديم أي وثائق مطلوبة وأي متطلبات قانونية أخرى أو الجائزة و/أو الوثائق المطلوبة بموجب القانون و/ أو مونستر إنرجي.

الإبلاغ وإيصال الجائزة

20. سوف يتمّ إبلاغ الفائز برسالة إلكترونية عبر البريد الإلكترونيّ، أو عن طريق الهاتف عبر رقم الهاتف الذي تمّ تقديمه للمشاركة في العرض، خلال خمسة (5) أيّام من تاريخ الاختيار ("الإبلاغ").  
21. لن يتمّ إبلاغ المشاركين غير الفائزين.  
22. سوف يتمّ توفير تفاصيل إيصال الجائزة إلى الفائز عند الإبلاغ.  
23. في حال لم تنجح مونستر إنرجي في التّواصل مع الفائز المُحتمل خلال يوميْن اثنيْن (2) من الإبلاغ، لأسباب خارجة عن إرادة شركة مونستر إنرجي (مثلا، الفائز لا يرد على الاتصالات، الهاتف غير متصل بالخدمة، وإلخ...)، أو إذا كان الفائز المُحتمل غير مؤهّل للحصول على الجائزة، أو إذا كان الفائز المحتمل غير متاح لحضور الفعالية، أو إذا كان الفائز المحتمل غير متاح لاستلام الجائزة لأيّ سبب كان، فسوف يتمّ إبطال وإلغاء هذه المُشاركة، وسوف تقوم مونستر إنرجي باختيار مشارَكة مؤهّلة أخرى في أقرب فرصة معقولة ومُمكنة بعدئذٍ.

الشّروط العامّة

24. المُشاركون محدودون بمشاركة واحدة (1) لكلّ شخص، ولا يجوز لأيّ مشارك أن يُرسل أو أن يُحاول إرسال أكثر من مُشارَكة واحدة (1) لكلّ شخص. تحتفظ مونستر إنرجي بالحقّ في رفض مُشارَكة أيّ شخص في العرض في حال قدّم أو حاول تقديم أكثر من مُشارَكة واحدة (1) لكلّ شخص.  
25. لا تُعتبر مؤهّلة تلك المُشارَكات التي تتمّ عبر الإنترنت باستخدام أساليب موُلّدة بفعل برنامج نصّيّ، أو "ماكرو"، أو أجهزة آليّة. تحتفظ مونستر إنرجي بالحقّ في التّأكّد من صلاحيّة المُشارَكات واستثناء المُشاركات التي يُعتقد أنّها أُرسِلَت باستخدام أيّ تقنيّات مُشاركة آليّة.  
26. تجنبًا للشك، يجب استخدام حاسوب أو جهاز آخر مزوّد بالإنترنت ومربوط بشبكة الإنترنت بهدف المُشاركة في العرض. يقع ضمن مسؤوليّة المُشاركين التّأكّد من حصولهم على المُصادقة من صاحب الحاسوب أو الشّخص الذي يدفع مقابل خدمة تزويد الإنترنت. لا تجوز المُطالبة بتسديد أيّ نفقات متعلّقة باستخدام وصلة الإنترنت بهدف المُشاركة في العرض.  
27. موعد استلام جميع المُشاركات هو موعد دخولها إلى قاعدة البيانات لدى مونستر إنرجي، وليس موعد إرسالها عبر الموقع من قبل المُشارك.  
28. في حال نشوب أيّ خلاف بخصوص هويّة الفائز، فإنّ قرار مونستر إنرجي هو النهائيّ.  
29. إنّ إرسال استمارة المُشاركة على الموقع أو أيّ نوع آخر من إثبات إرسال استمارة المُشاركة على الموقع لا يُعتبر إثباتًا باستلام المُشارَكة. لا تقبل مونستر إنرجي أيّ مسؤوليّة تجاه مشارَكات لم يتمّ استكمالها كما يجب، أو تلك الضّائعة، أو المتأخّرة، أو تلك التي لم يتمّ الحصول عليها لأيّ سبب كان.  
30. تكون الجائزة على النحو الموصوف أعلاه ولا يجوز تحويلها، أو استبدالها، ولن يُعطى أيّ بديل في حال لم يتمكّن الفائز من استلام الجائزة لأيّ سبب كان. على الرّغم ممّا سبق، في حال طرأت ظروف غير متوقّعة أو في حال لم تتمكّن مونستر إنرجي من إيصال الجائزة بسبب جائحة كوفيد-19 أو لأيّ سبب آخر، فإنّ مونستر إنرجي تحتفظ بحقّ استبدال جائزة بأكملها أو استبدال مركّبات من الجائزة بجوائز قيمتها مساوية أو تفوق قيمة الجائزة.  
31. الفائز الموافق على المُشاركة يجب أن يضمن موافقة الشخص المُختار على المشاركة بشكل معقول في أيّ إعلانات ناتجة عن العرض إذا طلبت منه ذلك مونستر إنرجي، ويجب أن يوافق الفائز والشخص المُختار على استخدام مونستر إنرجي لاسميهما، وصورهما، وتسجيلاتهما الصّوتيّة و/أو البصريّة في أيّ إعلانات تتعلّق بالعرض.  
32. في حال فشلت مونستر إنرجي في تلبية هذه الشّروط، فإنّها تتحمّل مسؤوليّة الخسارة أو الأذى الذي يتكبّده المُشارك بشكل كان في الإمكان توقّعه مُسبقًا نتيجة خرق مونستر إنرجي لهذه الشّروط أو نتيجة إهمالها، لكنّها لا تتحمّل مسؤوليّة أيّ خسارة أو أذى لم يكن في الإمكان توقّعه مسبقًا. في الإمكان توقّع الخسارة أو الأذى مُسبقًا في حال كانا نتاجًا واضحًا للخرق الذي تسبّبت به مونستر إنرجي أو في حال توقّعهما المُشارك ومونستر إنرجي ساعة مشاركة المشارك في العرض. عدا عن مسؤوليّة مونستر إنرجي لأّي خسارة أو أذى في الإمكان توقّعهما، فإنّ مونستر إنرجي و/أو أيّ من شركاتها التّابعة، و/أو موظّفيها، و/أو مديريها، و/أو وكلائها، و/أو أوصيائها، و/أو مقاوليها الفرعيّين، معفيّون من أيّ مسؤوليّة ومن جميع المسؤوليّات بأكبر قدر يُتيحه القانون.  
33. قد تطرأ أحداث تجعل العرض نفسه أو تقديم أيّ جوائز مستحيلَين، لأسباب خارج نطاق سيطرة مونستر إنرجي، وعليه قد تلجأ مونستر إنرجي حسب اعتباراتها الخاصّة والمطلقة، إلى تغيير أو تعديل العرض، ويوافق المُشارك على عدم تحميل مونستر إنرجي أيّ مسؤوليّة نتيجة لذلك.  
34. تحتفظ مونستر إنرجي بالحقّ في:  
(أ‌)    تغيير شكل العرض و/أو تأجيل العرض أو أيّ مرحلة من مراحله، بشكل كامل أو جزئيّ، لأسباب تفوق قدرتها المعقولة على التّحكّم، وذلك دون تحمّل أيّ مسؤوليّة تجاه المُشارك؛ و/أو  
(ب‌)    رفض مُشارَكة أيّ فرد في العرض أو في عروض مستقبليّة تنظّمها مونستر إنرجي: (1) في حال وُجِدَت أسباب تجعل مونستر إنرجي تعتقد بشكل معقول أنّ الجائزة حُوِّلَت إلى طرف آخر كلّيًّا أو جزئيًّا؛ (2) في حال حُرِمَ المُشارك من المُشاركة في أيّ مباراة أو عرض تابع لمونستر إنرجي في الأشهر الاثني عشر (12) السّابقين لتاريخ البداية؛ (3) في حال وُجِدت أسباب تجعل مونستر إنرجي تعتقد بشكل معقول أنّ هذا الفرد لم يلتزم بهذه الشّروط، و/أو (4) في حال لم يكن الفرد مؤهّلًا للمشاركة في العرض (أو في حال كان من المُفترض رفض مُشاركة الفرد في العرض لأيّ سبب كان).  
35. باستثناء المطروح صراحة في هذه الشّروط، لا تتحمّل مونستر إنرجي مسؤوليّة أيّ تكاليف أو نفقات قد يتحمّلها المُشارك. يتحمّل كلّ فائز مسؤوليّة أيّ ضرائب مفروضة في ما يتعلّق بجائزته.   
36. يُنصَح بأن يحتفظ جميع المُشاركين بنسخة عن هذه الشّروط والأحكام لمعاينتها مُستقبلًا.  
37. تقبل/ين بأن يتمّ استخدام اسمك علانيّة في حال كنت الفائز/ة. يمكن معرفة اسم الفائز من خلال الاتّصال بشركة مونستر إنرجي عبر www.monsterenergy.com/contact-us خلال 60 يومًا من تاريخ النّهاية.  
38. تحكم العرض وهذه الشّروط قوانين إنجلترا وويلز، وأيّ نزاعات (تعاقديّة أو غير تعاقديّة) تنشب إثر، أو بشكل يتعلّق بالعرض أو بهذه الشّروط تكون خاضعة للسّلطة القضائيّة غير الحصريّة التّابعة لمحاكم إنجلترا وويلز.

PROMOTION TERMS & CONDITIONS

Please read these terms & conditions (“Terms”) carefully.  By entering the Promotion (as defined below), you are agreeing to be bound by these Terms.  You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering this Promotion.

1.    Subject to the provisions of paragraph 4 below, this promotion (“Promotion") is open to all persons aged eighteen (18) years of age and over who are resident in Israel.   
2.    This Promotion is being organised and operated by Monster Energy Europe Limited of 7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD, United Kingdom (“Monster Energy”).    
3.    The Promotion is being conducted through the website at www.monsterenergy.com/mclaren_il  (the “Website”) and promoted through promotional material within retail stores in Israel which stock cans of the Monster Energy® brand product (each a “Store”).  
4.    No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion.   
5.    By entering this Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.  
6.    All times and dates set out in these Terms refer to the times and dates in Israel. In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.

Entry and Selection Process

7.    Proof of purchase is required for entry into this Promotion which includes: (i) retaining the three (3) 500ml cans of any Monster Energy brand product purchased for entry into the Promotion and submitting this to Monster Energy on request; and (ii) each entrant shall be required to upload a picture of themselves (a JPEG file not bigger than 5MB) onto the Website together with the three (3) 500ml cans of Monster Energy brand product (“Can Selfie”) (“Proof of Purchase”).  
8.    Entries are limited to one (1) entry per Receipt.  
9.    The commencement date of the Promotion is 00:00 on 01.08.2025 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 31.08.2025 (“Closing Date”).    
10.    Entrants may enter by:  
10.1.    acting in accordance with these Terms;  
10.2.     purchasing three (3) 500ml cans of Monster Energy brand product from a Store and retaining/complying  with the Proof of Purchase requirements; and  
10.3.    entering onto the Website the following:   
10.4.    submitting their details as directed on the Website (being, their full name, age, resident address, telephone number and email address); and  
10.5.    answering the following question in no more than thirty (30) words “Who is your favourite McLaren Formula 1 Team driver and why?” (“Answer”).  
11.    Each entrant that validly submits their entry as set out in paragraph 10 (together “Qualifying Entries” or each a “Qualifying Entrant”) will be entered into the Selection Process (defined below).  
12.    A panel consisting of at least one (1) Monster Energy representative and one (1) independent judge (which makes up the “Panel”) will collaborate and within ten (10) days of the Closing Date (“Selection Date”) to determine the following winner (the “Winner”):   
12.1.    one (1) winner of the Prize (as defined below) whose Answer best meets the Selection Criteria (as defined below)   
13.    The Panel shall determine the Winner based on the Answer which demonstrates the most creative and original response, ingenuity, the best understanding of Monster Energy®, and the best use of vocabulary and writing style (“Selection Criteria”).  
14.    The Panel shall ensure that the entries are valid in accordance with these Terms, judge the Qualifying Entries on the Selection Criteria, and assign the Prize (as defined below) to the Winner (the “Selection Process”).   
Prize and Requirements

15.    The Winner shall win a six (6) night trip for two (2) people to Abu Dhabi, the United Arab Emirates between 02.12.2025 and 08.12.2025 (“Trip”), as determined by Monster Energy in its complete discretion, to consist of the following (“Trip”) which shall consist of the following (“Prize”):  
15.1.    one (1) Monster Energy x McLaren meet and greet;  
15.2.    a six (6) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);  
15.3.    return economy flight tickets for two (2) people from an airport in Israel to an airport in the United Arab Emirates, as selected by Monster Energy (“Destination Point”), the airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion; and  
return economy transfers for two (2) people from the Destination Point to the Hotel, the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability.  
16.    Only the Winner and one (1) person, as chosen by the Winner, (the “Elected Person”) may enjoy the benefits of the Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Israel. The Winner and their Elected Person must hold valid passports that do not expire before 30.06.26 in order to redeem the Prize.   
17.    Before being declared the Winner and receiving the Prize, the potential winner and their Elected Person will be required to:  
17.1.    Provide Monster Energy with the potential winner’s Proof of Purchase, in the form as instructed by Monster Energy;  
17.2.    prove they satisfy the entry criteria set out in these Terms, including, without limitation, proof of age, residence and identity, which may include but is not limited to valid proof of residence, driver’s license, passport or similar government issued identification before receiving their Prize; and  
17.3.    will be required to sign a written confirmation of eligibility and waiver of liability before their Prize can be released to them, a copy of which is attached hereto as Appendix A.  Copies of the applicable confirmation and waiver can be obtained upon request to Gadi.Scheafer@Monsterenergy.com.  
Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the potential winner forfeiting their Prize and Monster Energy selecting another qualifying entry as soon as reasonably possible thereafter.  
18.    For the avoidance of doubt, all costs associated with the Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation, equipment, sustenance, any entertainment, and anything related to the Prize not specifically included and outlined in the definition of the Prize above will be borne solely by the Winner. Accommodation for the Prize is on a room only basis and Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Prize and all additional room charges.  
19.    It is the responsibility of the Winner to provide any required documentation and any other legal requirements or the Prize and/or documentation required by law and/or Monster Energy.  
Notification and Prize Delivery

20.    The Winner will be notified by email via the email address or telephone via the phone number provided to enter the Promotion within five (5) days of the Selection Date (“Notification”).      
21.    Non-winning entrants will not be notified.  
22.    The delivery details of the Prize shall be provided to the Winner at Notification.    
23.    In the event that Monster Energy cannot contact a potential winner within two (2) days of the Notification, for reasons not the fault of Monster Energy (e.g. winner is not responsive, telephone is disconnected, etc.)  a potential winner is ineligible to receive their Prize, a potential Winner is unavailable to attend the Event or a potential winner is unavailable to receive their Prize for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall select another Qualifying Entry as soon as reasonably possible thereafter.

General Terms

24.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry per person. Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry per person.  
25.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.  
26.    For the avoidance of doubt a computer or another internet-ready device and internet access is required to enter the Promotion.  It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider.  No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.  
27.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant.  
28.    If there is any dispute as to the identity of the Winner the decision of Monster Energy shall be final.  
29.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received.  Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.    
30.    The Prize is as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that the Winner is unable to claim their Prize for any reason whatsoever. Notwithstanding the foregoing, in the event of unforeseen circumstances or Monster Energy being unable to deliver the Prize due to the COVID-19 pandemic or for any other reason, Monster Energy reserves the right to replace an entire Prize or Prize components with prizes of equal or greater value.  
31.    The Winner agrees to participate shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winner and Elected Person consent to Monster Energy using their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion.  
32.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.  
33.    Events may occur that render the Promotion itself or the awarding of any Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.  
34.    Monster Energy reserve the right to:  
(a)     change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or  
(b)     refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).  
35.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. Each Winner will be liable for any tax chargeable in relation to their Prize.    
36.    It is advised that all entrants retain a copy of these terms and conditions for future reference.  
37.    You accept that your name may be made available to the public if you are a Winner. The Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 60 days of the Closing Date.  
38.    The Promotion and these Terms are governed by the laws of England and Wales and any disputes (contractual or non-contractual) arising under or in connection with the Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts of England and Wales.
