Terms and Conditions

1. These Terms and Conditions incorporate, and must be read together with, the details outlined in the table above.  Information about the Major Prize and how to enter forms part of these Terms and Conditions. By participating in the Promotion, you accept these Terms and Conditions.

Participation 

1. Buy, in one transaction, any 2 (two) Monster Energy 305mL or 500mL products (including all variants but excluding online and vending machine purchases) from any Participating Store identified by the display of in-store promotional material during the Promotion Period to receive your entry card with a unique code from the cashier, while stocks last.  To enter, scan the QR code on the card or visit https://www.monsterenergy.com. Enter your unique code online and fill in all mandatory fields to go in the draw. A full list of Participating Stores can be found on https://www.monsterenergy.com. No entries will be accepted outside the Promotion Period.
2. The Promoter is not responsible, and will not be liable, for any lost, incorrect, or misdirected web entries, or any website entries not received by the Promoter. Your entry redemption is deemed to be received only when received by the Promoter’s database. Incomplete or invalid entries or those not submitted in accordance with the entry instructions will not be accepted.

Prizes

1. There is a total prize pool valued at up to NZ $15,000. 
2. The Major Prize illustrated on any point-of-sale materials and social media images are not indicative of the exact prize. 
3. The Major Prize cannot be transferred or exchanged nor redeemed for cash. The estimated Major Prize value is correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in value. You agree that if the Major Prize (or any part of it) is unavailable for any reason beyond the Promoter’s reasonable control, the Promoter may provide another prize of equal or higher value, subject to applicable New Zealand law.
4. There will be a total of 85,000 entry cards printed and distributed to Participating Stores across New Zealand. 
5. The Promoter is not liable for entries, Major Prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible, or incorrectly submitted.
6. The Major Prize and all elements of it must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. The Major Prize is subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including:
7.  validity period/s;
8. booking and availability of flights, accommodation and events;
9. conditions of travel and conditions of entry into any venues (including behaviour requirements, COVID-19 safety requirements and applicable dress codes);
10. travel dates and specified travel exclusion periods; 
11. any additional fees (payable by you) relating to changes made by you/your companion to a Prize after it has been booked; 
12. the requirement to obtain all necessary documents to travel to any overseas location specified, including a current and valid passport and any visas required; and
13. a requirement to present your credit card when checking in to accommodation.
14. You/your companion (if applicable) are responsible for all other unspecified costs related to a Major Prize, including additional meals, transport, insurance (including excesses), in-room charges, additional taxes, installation costs etc. 
15. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share the Major Prize.
16. The Promoter accepts no responsibility if the event or activities awarded as part of the Major Prize are abandoned, called off or postponed for any reason outside the control of the Promoter. Unless otherwise specified by the Promoter, you will not be given cash or any alternative prize as a substitute for this altered prize element. 
17. Additional transfers to those specified and any Ground Operator Handling Fees are not included. The Winner and his/her companion are responsible for all other expenses including but not limited to meals, drinks, laundry charges, activities (unless specified), car hireage, hotel incidentals and in room charges, service charges, gratuities and additional taxes. Unless expressly stated in these Terms and Conditions all other travel and prize related expenses become the responsibility of the Winner and his/her companion. 
18. The Major Prize must be taken as offered and may not be deferred, is not transferable, and may not be exchanged for cash or taken in parts. Cost for changes made by the Winner (or his/her companion) to the travel elements included within the Major Prize after it has been booked must be paid by the Winner (or his/her companion).  The Winner will be required to present a valid credit card when checking in to the accommodation.
19. It is the responsibility of the Winner and his/her companion to ensure that they have full and correct travel documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and his/her companion. 
20. It is the responsibility of the Winner and his/her companion to meet any health and safety requirements applicable to the Major Prize (for example, in relation to COVID-19), including (but not limited to) obtaining any pre-departure tests or checks, or any other requirements, such as performing and returning negative COVID-19 tests, as may be required by third parties from time to time. 
21. If you are a Winner, you and (if applicable) your companion must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation.  You consent to the Promoter using your name and image in any promotional or advertising activity.
22. Any failure by you or your companion (if applicable) to comply with the conditions imposed by the Prize supplier/s may result in a Prize being cancelled or withdrawn without liability for the Promoter or the Prize supplier/s.
23. You/your companion (if applicable) must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the Major Prize. If you or your companion do not sign, your entry will be deemed invalid and you will lose any entitlement to the Major Prize. If you or your entry are deemed by the Promoter to breach these Terms and Conditions, including if you are unable to take the Major Prize on the relevant dates, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

General

1. Entrants into the Promotion must be aged 18 years or older and be resident in New Zealand.
2. The Promoter’s decisions and the draw results are final and not subject to appeal.
3. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, fraud, technical failures, governmental restraint, order or regulation, government pandemic restrictions or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole reasonable discretion, to cancel, terminate, modify or suspend the Promotion. Any cancellation, termination, modification or suspension of the Promotion will be notified on monsterenergy.com. 
4. If the Major Prize Winner or their entry is deemed by the Promoter to be in breach of these Terms and Conditions, the Major Prize Winner’s entry (or at the Promoter's reasonable discretion, all of their entries) may be discarded.  The Promoter may, at any time, require the Major Prize Winner to produce documentation to establish to the Promoter's satisfaction the validity of their entries (including documentation establishing the Major Prize Winner’s identity, age, place of residence and, to the extent applicable, place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
5. You must not:

(a) tamper with the entry process;

(b) engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner towards the Promoter or any of its related entities or the agencies or parties associated with this Promotion;

(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion;

(e) breach any law or regulation of New Zealand; or

(f) behave in a way that is otherwise inappropriate.

1. If you win the Major Prize, you are responsible for your companion, and the Promoter may disqualify all entries from, and prohibit further participation in this Promotion by, you or your companion if they breach these conditions, whether or not legally bound by them.
2. If you or your companion (if applicable), in the opinion of the Promoter are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this Promotion, or is contrary to law or is otherwise inappropriate, the Promoter may cancel the Major Prize or restrict you and your companion from participating in any elements of the Major Prize, at its discretion. 
3. If any dispute arises between you and the Promoter concerning the conduct of this Promotion or claiming the Major Prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this Promotion is final.
4. The Promoter is not responsible for any tax implications arising from you winning a Prize.  You should seek independent financial advice.  If for GST purposes this Promotion results in any supply being made for non-monetary consideration, you must follow the Inland Revenue’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
5. Any person suspected of cheating (in the opinion of the Promoter) through the manipulation of entry, creation, or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent (in the opinion of the Promoter) will be removed from this Promotion and damages may be sought. 

Liability

1. The Promoter and the agencies and companies associated with this Promotion are not liable for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Promotion or the Major Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
2. The Major Prize Winner has rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter.  These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill.  These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way.  However, to the extent that it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Major Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties. 
3. The Promoter may communicate or advertise this Promotion using Facebook or Instagram. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability in connection with this Promotion.

Collection and use of your personal information

1. The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, or Prize suppliers. Entry is conditional on providing this PI.  The Promoter will also use, and handle PI in accordance with the Privacy Act 2020 and as set out in its Privacy Policy, which can be viewed at www.ccamatil.com/nz/Privacy-policy. The Promoter will take reasonable steps to ensure that the third parties to whom the Promoter discloses PI are bound to protect the privacy of that PI. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Entrants’ details will be collected for the purposes of collating the entries for the draw, however, the Promoter will not disclose entrants’ personal information to any other entity outside of New Zealand. All entry information will be deleted within 3 months post-Promotion conclusion.
