Road to Snow Promotion (Promotion)

Terms and Conditions

These Terms and Conditions incorporate and must be read together with the details outlined in the table above.  Information about the Prize/s and how to enter the Promotion forms part of these Terms and Conditions.  By participating in the Promotion, you accept these Terms and Conditions.

Participation

1. To qualify to enter the Promotion, customers must purchase any two (2) 305ml or 500ml Monster Energy products (all variants, but excluding Monster Energy Import 550ml, online and vending machine purchases) in a single transaction during the Promotion Period at any Participating Store.
2. One entry form will be provided by the Participating Store cashier per Qualifying Purchase. For example, if 2 products are purchased in a single transaction = 1 entry form will be given, 4 products are purchased in a single transaction = 2 entry forms will be given, 6 products are purchased in a single transaction = 3 entry forms will be given and so on. Each entry form provides you with one entry into the Prize draw. The entry forms can only be obtained at the checkout at the time a Qualifying Purchase is made. Each entry form can only be used once.
3. To enter the Promotion, fill in all the required details in the entry form and drop it into the entry box. Entries must be submitted in the same Participating Store where the Qualifying Purchase is made.
4. Incomplete or invalid entries or those not submitted in accordance with these Terms and Conditions will not be accepted. The Promoter accepts no responsibility for late or lost entries.  Entries will not be accepted outside of the Promotion Period.

Prize

1. Each Prize is a Monster Energy Black Edition 156 Snowboard with an estimated value of $1,000NZD.  
2. The prize includes the snowboard only (no bindings).  Prizes illustrated on the point of sale, social images are not indicative of the exact Prizes. 
3. There is one Prize to be won at each Participating Store. See Participating Store list at www.monsterenergy.com.
4. The first valid entry drawn from the pool of entries received for each Participating Store, during the Promotion Period, will win the Prize.
5. Prizes are not transferable, exchangeable, or redeemable for cash. 
6. All Prizes will be delivered to each Prize Winner within 21 working days of receipt of a delivery address from the Prize Winner. The Promoter cannot guarantee desired delivery times or days.
7. The Promoter is not liable if the Prize Winner moves to a new address, or misspells or provides the wrong address to the Promoter. If Prizes are returned after reasonable carrier attempts to deliver the Prize to the Prize Winner, the Promoter will not be liable for resending the Prize. 
8.  You must, if required by the Promoter, and to the fullest extent permitted by law, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the Prize.  If you do not sign these documents, your entry will be deemed invalid and you will lose any entitlement to the Prize. You will be given a reasonable opportunity to review and consider these documents before signing. 

General

1. Entrants into the Promotion must be aged 18 years or older.
2. The Promoter’s decisions and the draw results are final and not subject to appeal.
3. If this Promotion cannot run as planned for any reason beyond the Promoter’s reasonable control, for example due to software, hardware or communication issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change or suspend the Promotion or disqualify affected entries/entrants, subject to any applicable law.  Any termination, amendment, suspension or cancellation of the Promotion will be notified on the Promoter’s website www.monsterenergy.com.
4. For reasons beyond the Promoter’s reasonable control, it may be necessary for the Promoter to amend these Terms and Conditions. Wherever possible, such amended terms and conditions will be displayed at Participating Stores and notified on the Promoter’s website www.monsterenergy.com.
5. Although the number of entries that can be submitted per person is not limited, a person may only win one Prize.  If an entrant is drawn as a Prize Winner for a second time, that Prize will be awarded to a Reserve Entrant. 
6. The Promoter and the agencies and companies associated with the Promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Promotion or any Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). 

Prize Winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose. These terms and conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties. 

1. If a Prize Winner is deemed by the Promoter to be in breach of these Terms and Conditions, that Prize Winner’s applicable entry (or at the Promoter’s reasonable discretion, all of the Prize Winner’s entries) may be discarded.  The Promoter may, at any time, require a Prize Winner to produce documentation to establish to the Promoter’s satisfaction the validity of their entry (including documentation establishing the Prize Winner’s identity, age, place of residence and, to the extent necessary, place of employment).  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
2. You must not:

(a) tamper with the entry process;

(b) engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;

(c) act in a disruptive, annoying, threatening, abusive or harassing manner towards the Promoter or any of its related entities or the agencies or parties associated with this Promotion;

(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion;

(e) breach any law or regulation of New Zealand; or

(f) behave in a way that is otherwise inappropriate. 

19.  The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

21. Prizes cannot be transferred or exchanged nor redeemed for cash.   The estimated Prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in value.  You agree that if the Prize is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any applicable law.

23. By accepting or participating in any Prize, you accept these Terms and Conditions.

24. Any person suspected of cheating (in the opinion of the Promoter) through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought. 

Liability

25. The Promoter and the agencies and companies associated with this Promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Promotion or the Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

26. The Promoter may communicate or advertise this Promotion using Facebook or Instagram. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability in connection with this Promotion.

Collection and use of your personal information

27. The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, or Prize suppliers. Entry is conditional on providing this PI.  The Promoter will also use, and handle PI in accordance with the Privacy Act 2020 and as set out in its Privacy Policy, which can be viewed at www.ccamatil.com/nz/Privacy-policy.  The Promoter will take reasonable steps to ensure that the third parties to whom the Promoter discloses PI are bound to protect the privacy of that PI. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. All entry information will be deleted within 3 months post-Promotion conclusion.
