CONDITIONS GÉNÉRALES DE LA PROMOTION 
Veuillez lire attentivement les présentes conditions générales (ci-après les « Conditions »). En participant à cette Promotion (ci-après la « Promotion ») vous acceptez d’être lié par ces Conditions. Vous devrez également lire notre politique de confidentialité qui explique comment les données fournies en vous inscrivant à la Promotion et que vous trouverez sur  www.monsterenergy.com seront utilisées. 
1.    La Promotion est organisée et réalisée par Monster Energy Europe Limited, domiciliée à 7 Cowley Business Park, Uxbridge UB8 2AD, Royaume-Uni (ci-après « Monster Energy »). La Promotion est ouverte à toutes les personnes de plus de dix-huit (18) ans qui résident en Suisse.
2.    Les employés et les membres de la famille des employés de Monster Energy et de ses sociétés affiliées, sous-traitants, agents ou concessionnaires ou toute personne associée professionnellement à la Promotion ne sont pas autorisés à participer à la Promotion.
3.    La Promotion est organisée sur le Site Internet de www.monsterenergy.com (le « Site Internet ») et figure sur des éléments promotionnels dans les lieux participants sélectionnés en Suisse (« Revendeur ».
4.    En participant à la Promotion conformément aux présentes Conditions, chaque participant (ci-après « vous », « votre » ou le « participant ») accepte d’être lié par les présentes Conditions et par la(les) décision(s) de Monter Energy, lesquelles sont définitives quant à toute question relative à la Promotion. Aucune autre correspondance ne sera initiée par Monster Energy.
5.    Toutes les heures et les dates figurant dans les présentes Conditions se réfèrent à des heures et des dates en Suisse. En cas de conflit au sujet de l'heure ou de la date d'envoi d'une inscription, la décision de Monster Energy sera définitive.
6.    Aucun achat de produit n'est nécessaire pour participer à la Promotion.

Participation

7.    La date de début de la Promotion est 00h00 le 15.09.2025 (ci-après la « Date de début ») et la date de clôture de la Promotion est 23h59 le 25.11.2025 (ci-après la « Date de clôture »).  
8.    Les participants peuvent s’inscrire à la Promotion en :
8.1.    se conformant aux présentes Conditions ; et
8.2.    et en soumettant leurs données de contact tel que cela est indiqué sur le Site Internet (nom et prénom, adresse du domicile, numéro de téléphone, date de naissance et adresse électronique.

Prix et exigences

9.    Tout participant qui soumet valablement son inscription comme décrit ci-dessus (chacun étant un « Participant valable ») participera à un tirage au sort du prix qui se tiendra dans les cinq (5) jours suivant la Date de clôture (« Tirage au sort »).
10.    Un (1) gagnant principal officiel sélectionné au hasard par le Tirage au sort (le « Gagnant principal ») remportera un voyage de trois (3) nuits pour deux (2) personnes en Californie, aux USA entre le 12.12.2025 et le 15.12.2025, les dates exactes seront déterminées par Monster Energy à son entière discrétion (le « Voyage ») qui se composera de ce qui suit (le « Prix principal ») :
10.1.     une (1) expérience de surf ;
10.2.    une (1) expérience de ski ou de snowboard ;
10.3.    une (1) rencontre avec un athlète Monster Energy® ;
10.4.    un hébergement de trois (3) nuits pour deux (2) personnes en chambre double dans un hôtel de    catégorie trois (3) étoiles ; l’hôtel qui sera sélectionné par Monster Energy à son entière discrétion, sous réserve de la disponibilité (l’« Hôtel ») ;
10.3.    les billets d’avion aller-retour en classe économique pour deux (2) personnes depuis un aéroport en Suisse vers un aéroport aux USA (« Point de destination ») ; les lieux des aéroports, les dates et heures des vols seront déterminés par Monster Energy à son entière discrétion, sous réserve de la disponibilité ; et 
10.6.     les transferts aller-retour en classe économique pour deux (2) personnes depuis le Point de destination vers l’Hôtel ; les heures et les modes de transport seront déterminés par Monster Energy à son entière discrétion sous réserve de la disponibilité. 
10.7.    Le Gagnant principal et une (1) personne choisie par le Gagnant principal (la « Personne choisie ») peuvent profiter des avantages du Prix. La Personne choisie doit être approuvée par Monster Energy, doit être âgée de plus de dix-huit (18) ans et doit résider en Suisse. Le Gagnant principal et la Personne choisie devront être en possession de passeports valides n’expirant pas avant le 30.06.2026 afin de récupérer le Prix principal.
11.    Cinq (5) premiers gagnants secondaires officiels sélectionnés au hasard par tirage au sort après la sélection du Gagnant principal (collectivement appelés les « Gagnants secondaires de rang un » et chacun étant un « Gagnant secondaire de rang un » remporteront chacun un (1) lot de surf des neiges de la marque Monster Energy® se composant d’un (1) snowboard et d’une (1) paire de lunettes de ski (« Prix des Gagnants secondaires de rang un »).
12.    Cinq (5) Gagnants secondaires de rang deux officiels sélectionnés au hasard par tirage au sort après la sélection des Gagnants secondaires de rang un collectivement appelés les « Gagnants secondaires de rang deux » et chacun étant un « Gagnant secondaire de rang deux » remporteront chacun un (1) lot de surf (1) de la marque Monster Energy® se composant d’une (1) planche de surf (1) et d’une (1) glacière à roulettes Igloo (« Prix des Gagnants secondaires de rang deux »).
13.    Seuls le Gagnant principal et une (1) personne choisie par lui (« Personne choisie ») peuvent bénéficier du Prix principal. La Personne choisie doit être approuvée par Monster Energy, être âgée de plus de dix-huit (18) ans et résider en Suisse. 
14.    Seuls les Gagnants secondaires de rang un peuvent bénéficier du Prix des Gagnants secondaires de rang un.
15.    Seuls les Gagnants secondaires de rang deux peuvent bénéficier du Prix des Gagnants secondaires de rang deux.
16.    Le Prix principal, le Prix des Gagnants secondaires de rang un et le Prix des Gagnants seront collectivement appelés les « Prix » et chacun étant un « Prix ».
17.    Le Gagnant principal, les Gagnants secondaires de rang un et de rang deux seront appelés collectivement les « Gagnants », chacun étant un « Gagnant ».
18.    Avant d’être déclaré Gagnant principal et de recevoir son Prix, il pourra être demandé au Gagnant potentiel et à la Personne choisie par lui de fournir une preuve de son éligibilité, y compris, sans que cela ne s’y limite, une preuve d’âge, résidence, identité qui pourra inclure sans s’y limiter, un justificatif de domicile, passeport, et/ou identification délivrée par le gouvernement. Le défaut de fournir ces informations à Monster Energy dans le délai raisonnable imparti par Monster Energy peut causer la perte du Prix par le Gagnant et la sélection d’une autre Participant valable effectué par Monster Energy dans un délai raisonnable.
19.    Le Gagnant principal devra signer une renonciation rédigée par Monster Energy, à son entière discrétion, spécifique au Prix principal correspondant, confirmant sa compréhension, son respect et son acceptation de la renonciation. Des copies de la confirmation et de la renonciation applicables peuvent être obtenues sur demande sur www.monsterenergy.com/contact-us
20.    Il relève de la responsabilité du Gagnant et de la Personne Choisie de se renseigner sur les conseils de voyage et les obligations d’entrée dans le pays où ils voyagent et s’assurer qu’ils possèdent tous les visas de voyage nécessaires.
21.    Afin de lever tout doute, tous les frais associés aux Prix, y compris, sans que cela ne s’y limite, les taxes, assurance santé valide pour les voyages, visa de tourisme (si applicable), transport (y compris les transferts entre les domiciles personnels du Gagnant principal et de la personne choisie et l’aéroport), l’hébergement, l’équipement, les repas, les loisirs ou tout ce qui peut avoir un lien avec les Prix non spécifiquement inclus et décrit dans la définition des Prix ci-dessus seront assumés uniquement par les Gagnants. L’hébergement pour le Prix principal se fait sur la base d’une chambre uniquement et le Gagnant principal et la Personne choisie seront seuls responsables des aliments et boissons consommés à l’Hôtel et ailleurs qui ne seraient pas spécifiquement inclus et indiqués dans la définition du Prix principal ainsi que de tous les autres frais en lien avec la chambre. Les Gagnants conviennent de signer et respecter les conditions générales fournies par les fournisseurs de services concernés de leur Prix.
22.    Il relève de la responsabilité des Gagnants de fournir toute documentation demandée et de respecter les obligations légales en lien avec leur Prix et/ou la documentation exigée par la loi et/ou Monster Energy.

Notification et livraison du prix

23.    Les Gagnants seront notifiés par email et/ou téléphone, à l’aide de l’adresse électronique et/ou du numéro de téléphone fournis lors de l’inscription à la Promotion dans les sept (7) jours suivant le tirage au sort (ci-après la « Notification »). Les participants perdants ne seront pas notifiés.
24.    Les informations de remise des Prix sera/seront déterminées par Monster Energy à son entière discrétion. Les informations de la remise des Prix (y compris, mais sans s’y limiter, l’heure, la date et le lieu de remise) seront communiquées aux Gagnants lors de la Notification.
25.    Si Monster Energy ne peut pas contacter un Gagnant potentiel dans les trois (3) jours suivant la Notification ou si le Gagnant potentiel n’est pas en mesure d’assister au Prix, cette participation sera réputée nulle et non avenante et Monster Energy devra sélectionner un autre Participant valable dès que cela est raisonnablement possible.

Dispositions générales

26.    Les Participants sont limités à une (1) participation par personne et chaque participant ne devra pas envoyer ni tenter d’envoyer plus d’une (1) participation.  Monster Energy se réserve le droit de refuser la participation d’une personne à la Promotion qui enverrait ou tenterait d’envoyer plus d’une (1) participation.
27.    Les inscriptions qui sont effectuées en ligne par des méthodes générées par script, par macro ou par l’utilisation de dispositifs automatisés ne seront pas valides. Monster Energy se réserve le droit de vérifier la validité des inscriptions et d’exclure les inscriptions qu’il estime avoir été effectuées à l’aide de techniques d’automatisation.  
28.    Afin de lever tout doute, un ordinateur ou un autre dispositif d’accès à Internet sont nécessaires pour participer à la Promotion.  Les participants ont la responsabilité de s’assurer qu’ils ont la permission du propriétaire de l’ordinateur et de la personne qui paye le fournisseur d’accès à Internet. Aucun remboursement ne pourra être réclamé pour des frais liés à l’utilisation de la connexion Internet pour les besoins de la participation à la Promotion.
29.    Toutes les participations sont réputées avoir été reçues au moment de l’inscription dans la base de données de Monster Energy et non au moment où la participation est envoyée au Site Internet par le participant.
30.    En cas de différend lié à l’identité d’un Gagnant, la décision de Monster Energy sera définitive. 
31.    La soumission d’une inscription en ligne ou toute autre forme de preuve de soumission d’une inscription en ligne n’est pas une preuve que votre inscription a été reçue. Monster Energy n’assume aucune responsabilité pour les inscriptions qui ne sont pas complétées de manière exacte, qui sont perdues ou en retard, ou qui ne sont pas reçues pour quelque raison que ce soit.
32.    Les Prix sont comme décrits et n’est pas transmissible ni échangeable et aucun équivalent en espèces ne sera proposé au cas où un Gagnant n’est pas en mesure de réclamer son Prix pour quelque raison que ce soit. En cas de circonstances imprévues ou si Monster Energy est dans l’incapacité de remettre un Prix à cause de la COVID-19, Monster Energy se réserve le droit de remplacer un Prix complet ou des éléments du prix par un prix de valeur égale ou supérieure. 
33.    Les Gagnants acceptent de participer et le Gagnant principal fera en sorte que la Personne choisie par lui accepte de participer à une publicité raisonnable résultant de la Promotion à la demande de Monster Energy, et les Gagnants et la Personne choisie par eux acceptent que Monster Energy puisse utiliser leur nom, photographie et/ou enregistrements audio et/ou vidéo dans toute publicité relative à la Promotion, tel que cela est décrit dans la politique de confidentialité de Monster Energy.
34.    Si Monster Energy ne respecte pas ces Conditions, elle engage sa responsabilité en cas de perte ou dommage subi par un participant qui est la conséquence prévisible d’une violation par Monster Energy de ces Conditions ou du fait de sa négligence mais n’est pas responsable en cas de perte ou dommage non prévisible. La perte ou le dommage est prévisible s’il y a eu une conséquence évidente de la violation par Monster Energy ou si cela était envisagé par le participant et Monster Energy au moment où le participant a participé à la Promotion. En plus de la responsabilité de Monster Energy pour une perte ou un dommage prévisible, Monster Energy et/ou une de ses filiales, employés, administrateurs, salariés, agents, personnes désignées ou sous-traitants renonce à toute responsabilité dans la mesure où cela est autorisé par la loi.
35.    Des événements peuvent survenir rendant la Promotion même ou l’attribution d’un Prix impossible en raison de circonstances qui ne dépendent pas du contrôle de Monster Energy et en conséquence, Monster Energy peut à sa discrétion absolue, modifier ou changer la Promotion et le participant accepte qu’aucune responsabilité ne lie Monster Energy à la suite de cela. 
36.    Monster Energy se réserve le droit de : (a) changer le format de la Promotion et/ou retarde

PROMOTION TERMS & CONDITIONS
Please read these terms & conditions (“Terms”) carefully. By entering this promotion (the “Promotion”), you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.
1.    The Promotion is being organised and operated by Monster Energy Europe Limited of Monster House, 7 Cowley Business Park, High Street, Uxbridge, UB8 2AD, United Kingdom (“Monster Energy”).
2.    The Promotion is open to all persons over eighteen (18) years of age and who are resident in Switzerland. No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion. 
3.    The Promotion is being conducted through the website at www.monsterenergy.com (the “Website”) and promoted through promotional material within selected participating locations in Switzerland (“Retailer”).
4.    By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.
5.    All times and dates set out in these Terms refer to the times and dates in Switzerland. In the event of any dispute over the time or date of any entry submitted the decision of Monster Energy shall be final.
6.    No purchase of any product is required to enter the Promotion. 
Entry

7.    The commencement date of the Promotion is 00:00 on 15.09.2025 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 25.11.2025 (“Closing Date”).  
8.    Entrants may enter the Promotion by: 
8.1.    acting in accordance with these Terms; and
8.2.    submitting their details as directed on the Website (being full name, residential address, telephone number, date of birth and email address).
Prize & Requirements

9.    Each entrant that validly submits their entry as set out above (each a “Valid Entrant”) will be entered into a random prize draw to be held within five (5) days of the Closing Date (“Draw”). 
10.    One (1) official main winner randomly selected from the Draw (“Main Winner”) shall win a three (3) night trip for two (2) people to California, USA between 12.12.25 and 15.12.25, exact dates to be determined by Monster Energy in its complete discretion (“Trip”), which shall consist of the following (“Main Prize”):
10.1.    one (1) surf experience;
10.2.    one (1) ski or snowboard experience;
10.3.    one (1) Monster Energy® athlete meet and greet;
10.4.    a three (3) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating; the hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);
10.5.    economy flight return tickets for two (2) people from an airport in Switzerland to an airport in the USA (“Destination Point”). The airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion, subject to availability; and
10.6.    return economy transfers for two (2) people from the Destination Point to the Hotel; the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability. 
10.7.    Only the Main Winner and one (1) person, as chosen by the Main Winner (the “Elected Person”), may enjoy the benefits of the Main Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Switzerland. The Main Winner and the Elected Person must hold valid passports that do not expire before 30.06.2026 in order to redeem the Main Prize. 
11.    Five (5) official first runners up randomly selected from the Draw following the selection of the Main Winner (collectively referred to as the "First Runners Up" and each a “First Runner Up”) shall each win one (1) Monster Energy® branded snowboarding package consisting of one (1) snowboard and one (1) pair of snow goggles (“First Runner Up Prize”).
12.    Five (5) official second runners up randomly selected from the Draw following the selection of the First Runners Up (collectively referred to as the "Second Runners Up" and each a “Second Runner Up”) shall each win one (1) Monster Energy® branded surf package consisting of one (1) surfboard and one (1) Igloo rolling cooler (“Second Runner Up Prize”).
13.    Only the Main Winner and one (1) person, as chosen by the Winner (“Elected Person”) may enjoy the benefits of the Main Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Switzerland. 
14.    Only the First Runners Up may enjoy the benefits of the First Runner Up Prize.
15.    Only the Second Runners Up may enjoy the benefits of the Second Runner Up Prize.
16.    The Main Prize, the First Runner Up Prize and the Second Runner Up Prize shall together be referred to as the “Prizes” and each a “Prize”.
17.    The Main Winner, the First Runners Up and the Second Runners Up shall together be referred to as the “Winners” and each a “Winner”. 
18.    Before being declared a Winner and receiving their Prize, a potential Winner and, where applicable their Elected Person, may be required to prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/or similar government issued identification. Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Winner forfeiting their Prize and Monster Energy selecting another Valid Entrant as soon as reasonably possible thereafter.
19.    The Main Winner and the Elected person will be required to sign a waiver prepared by Monster Energy, in its complete discretion, specific to the relevant Main Prize confirming understanding, compliance with and acceptance of the waiver. Copies of the applicable confirmation and waiver can be obtained upon request from www.monsterenergy.com/contact-us.
20.    It is the responsibility of the Main Winner and their Elected Person to check travel advice for the entry requirements of the country they are travelling to and ensure they have arranged for all necessary travel visas.
21.    For the avoidance of doubt, all costs associated with the Prizes, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation (including transfers between the Main Winner and the Elected Person's home(s) and the airport), accommodation, equipment, sustenance, any entertainment and anything related to the Prizes not specifically included and outlined in the definition of the Prizes above will be borne solely by the Winners. Accommodation for the Main Prize is on a room only basis and the Main Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Main Prize and all additional room charges. The Winners hereby agree to sign and comply with any terms and conditions provided by the relevant service providers for their Prize.
22.    It is the responsibility of the Winners to provide any required documentation and any other legal requirements for their Prize and/or documentation required by law and/or Monster Energy.  

Notification and Prize Delivery

23.    The Winners will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within seven (7) days of the Draw (“Notification”). Unsuccessful entrants will not be notified.
24.    The delivery details of the Prizes shall be determined by Monster Energy in its complete discretion.  Details of delivery of the Prizes (including but not limited to the time, date and location of delivery) shall be provided to the Winners at Notification.
25.    In the event that Monster Energy cannot contact a potential Winner within three (3) days of the Notification or a potential Winner is unavailable to receive their Prize, or a potential Main Winner is unavailable to attend the Trip for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall select another Valid Entrant as soon as reasonably possible thereafter.
General Terms

26.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
27.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices. Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
28.    For the avoidance of doubt a computer or another internet ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider. No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
29.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant. 
30.    If there is any dispute as to the identity of a Winner, the decision of Monster Energy shall be final.
31.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received. Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.  
32.    The Prizes are as described and are not transferable, not exchangeable and no cash alternative will be offered in the event that a Winner is unable to claim their Prize for any reason whatsoever. In the event of unforeseen circumstances or Monster Energy being unable to deliver a Prize due to COVID-19, Monster Energy reserves the right to replace the entire Prize or prize components with a prize of equal or greater value.
33.    The Winners agree to participate and the Main Winner shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winners and the Elected Person acknowledge that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
34.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.
35.    Events may occur that render the Promotion itself or the awarding of a Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
36.    Monster Energy reserves the right to: (a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or (b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that a Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
37.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Winners will be liable for any tax chargeable in relation to their Prize. 
38.    It is advised that all entrants retain a copy of these Terms for future reference.
39.    You accept that your name may be made available to the public if you are a Winner. The Winners’ names are available by contacting Monster Energy at www.monsterenergy.com/contact-us within ninety (90) days of the Closing Date.
40.    The Promotion and these Terms are governed by the laws of Switzerland.
41.    Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in Switzerland.
