תנאים כלליים של המבצע

נא  קראו בעיון תנאים כלליים אלו (להלן: "התנאים"). השתתפות במבצע (כהגדרתו להלן) מהווה הסכמה מצדך להיות כפוף לתנאים אלה. קרא את מדיניות הפרטיות שלנו בכתובת www.monsterenergy.com ובה הסבר על האופן בו נעשה שימוש בנתונים שאתה מוסר לנו כשאתה משתתף במבצע קידום מכירות זה.

1.    בכפוף להוראות סעיף 4 להלן, מבצע זה (להלן: "המבצע") פתוח לכל בני ובנות 18 שנה ומעלה שהם תושבי ישראל.   
2.    המבצע מאורגן ומופעל על-ידי Monster Energy Europe Limited שכתובתה7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD,, בריטניה (להלן: " Monster Energy").  
3.    המבצע מנוהל באמצעות אתר אינטרנט זה שכתובתו www.monsterenergy.com/mclaren_il (להלן: "האתר") והוא מקודם באמצעות חומרי קידום שיווקיים המופצים בחנויות בהן  פחיות של המותגMonster Energy®  (להלן: "חנות").   
4.    אף עובד או קרוב משפחה של עובד בחברת Monster Energy או באחת מן החברות המסונפות לה, קבלני משנה, סוכנים או זכיינים או כל אדם אחר הקשור בקשר מקצועי עם המבצע, אינו רשאי להשתתף במבצע.   
5.    מעצם השתתפותו במבצע זה בכפוף לתנאים, כל משתתף (להלן, לפי המקרה: "אתה", "שלך", "משתתף") מסכים להיות כפוף לתנאים אלה ולהחלטות של Monster Energy, שהחלטתה בכל עניין הקשור למבצע זה תהיה סופית ומחייבת. לא תימסר בנושא אף הודעה נוספת על ידי Monster Energy.   
6.    כל הזמנים והתאריכים הקבועים בתנאים אלה מתייחסים לזמנים ולתאריכים בישראל. במקרה של מחלוקת כלשהי לגבי זמן או תאריך הגשת מענה כלשהו, החלטת Monster Energy תהה סופית.

תהליך הכניסה והמיון

7.    לצורך כניסה למבצע זה נדרשת הוכחת קנייה, הכוללת: (א) שמירה על שלוש (3) פחיות 500 מ"ל של מוצר כלשהו ממותג Monster Energy הנדרשים להשתתפות במצבע והצגתן ל- Monster Energy לפי דרישה; ו (ב) כל משתתף יידרש להעלות תמונה של עצמו/ה (קובץ JPEG שגודלו עד 5MB) לאתר יחד עם שלוש (3) פחיות 500 מ"ל של מוצר ממותג Monster Energy ("סלפי פחיות") ("הוכחת קניה")  
8.    ההשתתפות במבצע מוגבלת להשתתפות אחת (1) לקבלה.  
9.    המבצע יחל בשעה 00:00 ביום 01.08.2025 ("תאריך התחלה") ויסתיים בשעה 23:59 ביום 31.08.2025 ("תאריך הסיום").    
10.    משתתפים יוכלו להשתתף במבצע אם:  
10.1.    יפעלו בהתאם לתנאים אלה;  
10.2.    ירכשו שלוש (3) פחיות 500 מ"ל של מוצר ממותג Monster Energy מחנות ועמידה בדרישות הוכחת הקנייה; ו  
10.3.    הכנסת הנתונים הבאים לאתר:  
10.4.    הגשת פרטיהם האישיים בהתאם להנחיות המופיעות באתר (דהיינו שם מלא, גיל, כתובת מגורים, מס' טלפון וכתובת דוא"ל); ו -  
10.5.    מענה על השאלה הבאה באמצעות לא יותר מ- 30 מלים: "מיהו נהג קבוצת מקלארן פורמולה 1 האהוב עליך ביותר ומדוע?" (להלן: "התשובה").   
11.    כל משתתף העומד בהוראות אלו אשר הזין את הפרטים הדרושים כאמור בסעיף 10 לעיל (להלן, וביחד: "מענים כשירים" או לחוד: "משתתף כשיר") יעבור הלאה לתהליך המיון (כהגדרתו להלן).  
12.    הרכב שופטים הכולל לפחות נציג אחד (1) מטעם Monster Energy ושופט בלתי תלוי אחד (1) (להלן: "הרכב השופטים") ישתפו פעולה, ותוך עשרה (10) ימים מתאריך הסיום (להלן: "תאריך הבחירה") יבחרו את הזוכה הבא (ה"זוכה"):  
12.1.    זוכה אחד (1) בפרס (כמוגדר להלן) אשר תשובותיו התאימו בצורה הטובה ביותר לקריטריוני המיון (כמוגדרים להלן).  
13.    הרכב השופטים יקבע את הזוכה בהתבסס על התשובה שתימצא כתגובה היצירתית והמקורית ביותר, עם כושר ההמצאה וההבנה הטובה ביותר של Monster Energy®, והשימוש הטוב ביותר באוצר מילים וסגנון כתיבה (להלן: "קריטריוני המיון").  
14.    הרכב השופטים יוודא שהתשובות תקפות מבחינת התנאים, ישפוט את המענים הכשירים בהתאם לקריטריוני המיון ויעניק את הפרס (כהגדרתו להלן) לזוכה (להלן: "תהליך המיון").

הפרס והדרישות

15.    הזוכה יזכה בנסיעה זוגית (עבור שני אנשים) לשישה (6) לילות באבו דאבי, איחוד האמירויות הערביות, שתתקיים החל מה-2 בדצמבר 2025 עד ה-8 בדצמבר 2025 ("נסיעה"), כפי שייקבע על ידי Monster Energy ובכפוף לשיקול דעתה הבלעדי, ואשר תכלול את האמור להלן ("נסיעה"), המהווה את האמור להלן ("פרס"):   
15.1.    אירוע "meet and greet" אחד (1) של Monster Energy  ו-McLaren ;  
15.2.    שהות של שישה (6) לילות עבור שני (2) אנשים בחדר זוגי במלון בדירוג של שלושה (3) כוכבים לפחות. בית המלון ייבחר על ידי Monster Energy לפי שיקול דעתה הבלעדי, בכפוף לזמינות ("מלון");  
15.3.    טיסה הלוך ושוב במחלקת תיירים עבור שני (2) אנשים מנמל תעופה בישראל לנמל תעופה באיחוד האמירויות הערביות, כפי שנבחרה על ידי Monster Energy (להלן: "נקודת היעד"). מיקום נמל התעופה, תאריכי ושעות הטיסות ייקבעו על ידיMonster Energy ולפי שיקול דעתה הבלעדי, וכן העברות עבור שני (2) אנשים מנקודת היעד אל המלון. המועדים ואופן ההעברה ייקבעו על ידי Monster Energy ולפי שיקול דעתה הבלעדי, בכפוף לזמינות;  
16.    רק הזוכה ואדם אחד (1) אשר נבחר על ידי הזוכה (ה"אדם הנבחר") מורשים ליהנות מיתרונות הפרס. האדם הנבחר יאושר על ידי Monster Energy. עליו להיות מעל גיל שמונה עשרה (18) ולהיות תושב מדינת ישראל. לצורך מימוש הפרס על הזוכה והאדם הנבחר שלו להחזיק בדרכונים שתוקפם לכל הפחות עד ה- 30.06.26.   
17.    לפני שיוכרז כזוכה ויקבל את הפרס, הזוכה הפוטנציאלי והאדם הנבחר שלו:  
17.1.    יידרשו לספק ל- Monster Energy את הוכחת הקניה של הזוכה הפוטנציאלי, באופן שהוגדר על ידי Monster Energy;  
17.2.    יידרשו להוכיח שהם עומדים בקריטריונים הקבועים בתנאים אלה, כולל, בין היתר, הוכחת גיל, כתובת וזהות, שעשויה לכלול, בין היתר, הוכחת מגורים תקפה, רישיון נהיגה, דרכון או מסמך זיהוי ממשלתי אחר, בטרם קבלת הפרס; וכן  
17.3.    יידרשו לחתום על כתב אישור לזכאות ו-ויתור על כל חבות, לפני שניתן יהיה להעניק להם את הפרס. עותק של מסמך זה מצורף כנספח א' לתנאים אלו. עותק של כתב האישור והוויתור ניתן יהיה לקבל בפנייה באמצעות הדוא"ל לכתובת Gadi.Scheafer@Monsterenergy.com.  
במידה ופרטים אלה לא יימסרו ל-Monster Energy תוך פרק זמן סביר כפי שייקבע על-ידי Monster Energy, עלול הדבר לגרום לכך שהזוכה הפוטנציאלי יפסיד את זכאותו לקבלת הפרס ו- Monster Energy תהיה רשאית לבחור זוכה אחר זמן סביר לאחר שהדבר יתאפשר.  
18.    למען הסר ספק, כל העלויות הכרוכות בפרס, כולל, בין היתר, מס, ביטוח בריאות תקף לנסיעות, ויזת תייר (אם נדרשת), העברות ציוד, הזנה, בידור כלשהו, וכל דבר הקשור לפרס ואינו כלול באופן ספציפי ומפורש בהגדרת הפרס להלן, יכוסו בלעדית על ידי הזוכה. לינה במסגרת הפרס היא על בסיס חדר בלבד והזוכה והאדם הנבחר שלו יהיו אחראים עבור כל מזון ומשקה שנצרך בבית המלון ובמקומות אחרים אשר אינם כלולים באופן ספציפי ומפורש בהגדרת הפרס וכן בכל העלויות הנוספות לחדר.  
19.    באחריות הזוכה לספק את כל המסמכים הנדרשים ולעמוד בכל דרישה משפטית אחרת הקשורה בפרס ו/או מסמכים הנדרשים על פי חוק ו/או על ידי Monster Energy.

הודעת הזכייה ומסירת הפרס

20.    הזוכה יקבלו הודעה בדוא"ל לכתובת הדוא"ל שמסר או בטלפון למס' הטלפון שמסר לצורך ההשתתפות במבצע, וזאת תוך חמישה (5) ימים ממועד בחירת הזוכה (להלן: "הודעה").  
21.    משתתפים שלא זכו לא יקבלו הודעה בדבר אי זכייתם.  
22.    פרטים לגבי הענקת הפרס יימסרו לזוכה במסגרת ההודעה כאמור.    
23.    במידה ו-Monster Energy לא תצליח ליצור קשר עם זוכה פוטנציאלי לצורך קבלת הפרס תוך יומיים ממועד ההודעה מסיבות שלא באשמת Monster Energy (למשל, הזוכה אינו מגיב, הטלפון מנותק וכו'), זוכה פוטנציאלי זה לא יהיה זכאי לפרס, או במידה וזוכה פוטנציאלי אינו זמין להשתתף באירוע או במידה וזוכה פוטנציאלי לא יוכל לקבל את הפרס מכל סיבה שהיא, השתתפותו תחשב בטלה ומבוטלת ו-Monster Energy תבחר זוכה זכאי אחר זמן סביר לאחר שהדבר יתאפשר.

תנאים כלליים

24.    משתתפים מוגבלים למענה אחד (1) לאדם ומשתתף לא יגיש או ינסה להגיש יותר ממענה אחד (1) לאדם. Monster Energy שומרת לעצמה את הזכות לסרב לקבל מענה למבצע של כל אדם אם יגיש או ינסה להגיש יותר ממענה אחד (1) לאדם.  
25.    מענים לא יהיו תקפים אם נשלחו באופן מקוון תוך שימוש בשיטות המופקות על-ידי קובץ פקודות (script), מאקרו או שימוש במנגנון אוטומטי. Monster Energy שומרת לעצמה את הזכות לאמת את תקפותם של המענים ולדחות מענים שלדעתה בוצעו באמצעות שיטות מענה אוטומטיות.  
26.    למען הסר ספק, מחשב או מכשיר אחר שמחובר לאינטרנט וגישה לאינטרנט נדרשים לצורך ההשתתפות במבצע. באחריות המשתתפים לוודא כי קיבלו הרשאה מבעל המחשב וממי שמשלם לספק שירות האינטרנט. לא ניתן לתבוע החזר בגין הוצאות שהוצאו בקשר לשימוש באינטרנט לצורך ההשתתפות במבצע.  
27.    כל המענים נחשבים כאילו התקבלו במועד הזנתם למסד הנתונים של Monster Energy ולא במועד שליחתם לאתר על-ידי המשתתף.  
28.    בכל מחלוקת שתתגלע בקשר לזהות הזוכה, החלטתה של Monster Energy תהיה סופית ומחייבת.  
29.    הגשה מקוונת של טופס מענה או כל צורת הוכחה אחרת להגשה מקוונת של טופס מענה אינה מהווה הוכחה לכך כי מענך התקבל על ידי Monster Energy, ו-Monster Energy אינה נושאת באחריות על מענים שהושלמו באופן שגוי, אבדו, הגיעו באיחור או לא התקבלו מכל סיבה שהיא.    
30.    הפרס הינו כמתואר ואינו ניתן להעברה או להחלפה ולא תוצע שום חלופה כספית במידה והזוכה לא יוכל לקבל את הפרס שלו מכל סיבה שהיא. על אף האמור לעיל, במקרה של נסיבות בלתי צפויות או במידה ש-Monster Energy לא תוכל להעניק את הפרס לאור מגיפת וירוס הקורונה (COVID-19) או מכל סיבה אחרת,  Monster Energyשומרת לעצמה את הזכות להחליף את הפרס, כולו או חלקים ממנו, בפרסים שווי ערך או בשווי גבוה יותר.  
31.    הזוכה ידאג לכך כי האדם הנבחר מסכים להשתתף בפרסומים סבירים הנובעים מהמבצע אם הם יתבקשו לעשות כן על ידי Monster Energy, והזוכה והאדם הנבחר מסכימים ש-Monster Energy תעשה שימוש בשמם, בצילום ו/או בהקלטות שמע ו/או בסרטונים בהשתתפותם בכל פרסום בקשר למבצע זה.  
32.    במידה ו-Monster Energy לא תציית לתנאים אלה, היא תישא באחריות להפסדים או לנזקים שייגרמו למשתתף שהם תוצאה צפויה של הפרת תנאים אלה או כתוצאה של רשלנות מצד Monster Energy, אך היא לא תישא באחריות להפסדים או נזקים שלא ניתן היה לחזותם מראש. הפסדים או נזקים ייחשבו לנזקים צפויים אם היו תוצאה ברורה של הפרה מצד Monster Energy או אם הם נגרמו על-ידי המשתתף ו-Monster Energy במועד כניסת המשתתף למבצע. לצד חבותה של Monster Energy בגין הפסדים או נזקים צפויים, Monster Energy ו/או כל אחת ממסונפותיה, עובדיה, מנהליה, סוכניה, זכייניה או קבלני המשנה שלה, מתנערים מכל חבות במידה הרחבה ביותר המותרת לפי החוק.  
33.    עלולים להתרחש אירועים אשר יהפכו את המבצע עצמו או את ההענקה של כל פרס במסגרתו לבלתי אפשריים מסיבות שאינן בשליטתה של Monster Energy, ולפיכך Monster Energy עשויה, לפי שיקול דעתה הבלעדי, לבצע שינויים במבצע, והמשתתף מסכים שלא תוטל שום חבות על Monster Energy בגין כך.  
34.    Monster Energy שומרת לעצמה את הזכות:  
(א)  לשנות את מתכונת המבצע ו/או לדחות או לעכב את המבצע או כל שלב בו, כולו או מקצתו, בשל סיבות שאינן בשליטתה הסבירה, ללא חבות לטובת המשתתף; ו/או  
(ב)  לסרב לקבל את השתתפותו של כל אדם במבצע או במבצעים עתידיים שיאורגנו על-ידי Monster Energy: (1) מקום בו ל- Monster Energy יש סיבות להאמין שהפרס, כולו או מקצתו, הוענק לצד ג'; (2) מקום בו משתתף נפסל מלהשתתף בכל תחרות או מבצע של Monster Energy בשניים עשר (12) החודשים שלפני תאריך ההתחלה; (3) מקום בו ל-Monster Energy יש סיבות להאמין שאותו אדם לא ציית לתנאים אלה; ו/או (4) מקום בו אותו אדם אינו כשיר להשתתף במבצע (או אם צריך היה לסרב לקבל את השתתפותו מכל סיבה שהיא).  
35.    למעט כמפורט במפורש בתנאים אלה, Monster Energy לא תישא בכל חבות לכל עלות או הוצאה שתוטל על כל משתתף. כל זוכה יהיה חייב במס המוטל בקשר לפרס שיוענק לו.    
36.    מומלץ לכל המשתתפים לשמור עותק של תנאים אלה לצורך עיון עתידי.  
37.    הנך מסכים/ה ששמך יועבר לידיעת הציבור אם תהיה הזוכה. שם הזוכה יהיה זמין בפנייה ל- Monster Energy באתר www.monsterenergy.com/contact-us תוך 60 יום מתאריך הסיום.  
38.    המבצע ותנאיו כפופים לחוקי אנגליה וויילס; כל מחלוקת (חוזית או לא חוזית) שתתגלע בקשר למבצע או לתנאים אלה תהיה כפופה לסמכות השיפוט הלא בלעדית של בתי המשפט של אנגליה וויילס.

PROMOTION TERMS & CONDITIONS

Please read these terms & conditions (“Terms”) carefully.  By entering the Promotion (as defined below), you are agreeing to be bound by these Terms.  You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering this Promotion.

1.    Subject to the provisions of paragraph 4 below, this promotion (“Promotion") is open to all persons aged eighteen (18) years of age and over who are resident in Israel.   
2.    This Promotion is being organised and operated by Monster Energy Europe Limited of 7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD, United Kingdom (“Monster Energy”).    
3.    The Promotion is being conducted through the website at www.monsterenergy.com/mclaren_il  (the “Website”) and promoted through promotional material within retail stores in Israel which stock cans of the Monster Energy® brand product (each a “Store”).  
4.    No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion.   
5.    By entering this Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.  
6.    All times and dates set out in these Terms refer to the times and dates in Israel. In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.

Entry and Selection Process

7.    Proof of purchase is required for entry into this Promotion which includes: (i) retaining the three (3) 500ml cans of any Monster Energy brand product purchased for entry into the Promotion and submitting this to Monster Energy on request; and (ii) each entrant shall be required to upload a picture of themselves (a JPEG file not bigger than 5MB) onto the Website together with the three (3) 500ml cans of Monster Energy brand product (“Can Selfie”) (“Proof of Purchase”).  
8.    Entries are limited to one (1) entry per Receipt.  
9.    The commencement date of the Promotion is 00:00 on 01.08.2025 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 31.08.2025 (“Closing Date”).    
10.    Entrants may enter by:  
10.1.    acting in accordance with these Terms;  
10.2.     purchasing three (3) 500ml cans of Monster Energy brand product from a Store and retaining/complying  with the Proof of Purchase requirements; and  
10.3.    entering onto the Website the following:   
10.4.    submitting their details as directed on the Website (being, their full name, age, resident address, telephone number and email address); and  
10.5.    answering the following question in no more than thirty (30) words “Who is your favourite McLaren Formula 1 Team driver and why?” (“Answer”).  
11.    Each entrant that validly submits their entry as set out in paragraph 10 (together “Qualifying Entries” or each a “Qualifying Entrant”) will be entered into the Selection Process (defined below).  
12.    A panel consisting of at least one (1) Monster Energy representative and one (1) independent judge (which makes up the “Panel”) will collaborate and within ten (10) days of the Closing Date (“Selection Date”) to determine the following winner (the “Winner”):   
12.1.    one (1) winner of the Prize (as defined below) whose Answer best meets the Selection Criteria (as defined below)   
13.    The Panel shall determine the Winner based on the Answer which demonstrates the most creative and original response, ingenuity, the best understanding of Monster Energy®, and the best use of vocabulary and writing style (“Selection Criteria”).  
14.    The Panel shall ensure that the entries are valid in accordance with these Terms, judge the Qualifying Entries on the Selection Criteria, and assign the Prize (as defined below) to the Winner (the “Selection Process”).   
Prize and Requirements

15.    The Winner shall win a six (6) night trip for two (2) people to Abu Dhabi, the United Arab Emirates between 02.12.2025 and 08.12.2025 (“Trip”), as determined by Monster Energy in its complete discretion, to consist of the following (“Trip”) which shall consist of the following (“Prize”):  
15.1.    one (1) Monster Energy x McLaren meet and greet;  
15.2.    a six (6) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);  
15.3.    return economy flight tickets for two (2) people from an airport in Israel to an airport in the United Arab Emirates, as selected by Monster Energy (“Destination Point”), the airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion; and  
return economy transfers for two (2) people from the Destination Point to the Hotel, the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability.  
16.    Only the Winner and one (1) person, as chosen by the Winner, (the “Elected Person”) may enjoy the benefits of the Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Israel. The Winner and their Elected Person must hold valid passports that do not expire before 30.06.26 in order to redeem the Prize.   
17.    Before being declared the Winner and receiving the Prize, the potential winner and their Elected Person will be required to:  
17.1.    Provide Monster Energy with the potential winner’s Proof of Purchase, in the form as instructed by Monster Energy;  
17.2.    prove they satisfy the entry criteria set out in these Terms, including, without limitation, proof of age, residence and identity, which may include but is not limited to valid proof of residence, driver’s license, passport or similar government issued identification before receiving their Prize; and  
17.3.    will be required to sign a written confirmation of eligibility and waiver of liability before their Prize can be released to them, a copy of which is attached hereto as Appendix A.  Copies of the applicable confirmation and waiver can be obtained upon request to Gadi.Scheafer@Monsterenergy.com.  
Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the potential winner forfeiting their Prize and Monster Energy selecting another qualifying entry as soon as reasonably possible thereafter.  
18.    For the avoidance of doubt, all costs associated with the Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation, equipment, sustenance, any entertainment, and anything related to the Prize not specifically included and outlined in the definition of the Prize above will be borne solely by the Winner. Accommodation for the Prize is on a room only basis and Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Prize and all additional room charges.  
19.    It is the responsibility of the Winner to provide any required documentation and any other legal requirements or the Prize and/or documentation required by law and/or Monster Energy.  
Notification and Prize Delivery

20.    The Winner will be notified by email via the email address or telephone via the phone number provided to enter the Promotion within five (5) days of the Selection Date (“Notification”).      
21.    Non-winning entrants will not be notified.  
22.    The delivery details of the Prize shall be provided to the Winner at Notification.    
23.    In the event that Monster Energy cannot contact a potential winner within two (2) days of the Notification, for reasons not the fault of Monster Energy (e.g. winner is not responsive, telephone is disconnected, etc.)  a potential winner is ineligible to receive their Prize, a potential Winner is unavailable to attend the Event or a potential winner is unavailable to receive their Prize for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall select another Qualifying Entry as soon as reasonably possible thereafter.

General Terms

24.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry per person. Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry per person.  
25.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.  
26.    For the avoidance of doubt a computer or another internet-ready device and internet access is required to enter the Promotion.  It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider.  No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.  
27.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant.  
28.    If there is any dispute as to the identity of the Winner the decision of Monster Energy shall be final.  
29.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received.  Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.    
30.    The Prize is as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that the Winner is unable to claim their Prize for any reason whatsoever. Notwithstanding the foregoing, in the event of unforeseen circumstances or Monster Energy being unable to deliver the Prize due to the COVID-19 pandemic or for any other reason, Monster Energy reserves the right to replace an entire Prize or Prize components with prizes of equal or greater value.  
31.    The Winner agrees to participate shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winner and Elected Person consent to Monster Energy using their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion.  
32.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.  
33.    Events may occur that render the Promotion itself or the awarding of any Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.  
34.    Monster Energy reserve the right to:  
(a)     change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or  
(b)     refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).  
35.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. Each Winner will be liable for any tax chargeable in relation to their Prize.    
36.    It is advised that all entrants retain a copy of these terms and conditions for future reference.  
37.    You accept that your name may be made available to the public if you are a Winner. The Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 60 days of the Closing Date.  
38.    The Promotion and these Terms are governed by the laws of England and Wales and any disputes (contractual or non-contractual) arising under or in connection with the Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts of England and Wales.
