UFC iskustvo 2025 - Monster Energy

DUGA VERZIJA OPĆIH UVJETA PROMOCIJE    
Pažljivo pročitajte ove opće uvjete („Uvjeti”). Sudjelovanjem u ovoj promociji („Promocija”), prihvaćate da Vas obvezuju ovi Uvjeti. Pročitajte i pravila o privatnosti podataka na www.monsterenergy.com koja objašnjavaju kako ćemo se koristiti podacima koje nam pružite pri prijavi u Promociju.
1.    Promociju organizira i provodi ju Monster Energy Europe Limited, 7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD, Ujedinjena Kraljevina („Monster Energy”).
2.    Promocija je otvorena za sve osobe starije od osamnaest (18) godina i koje imaju prebivalište u Hrvatskoj. Sudjelovanje u Promociji nije dopušteno niti jednom zaposleniku ni članu obitelji zaposlenika tvrtke Monster Energy, Zuffa LLC njihovim povezanim društvima, podizvođačima, agentima ili upućenicima kao ni bilo kojoj drugoj osobi profesionalno povezanoj s Promocijom.
3.    Promocija se provodi putem internetske stranice na www.monsterenergy.com („Internetska stranica”) i promovira se putem promotivnog materijala na odabranim lokacijama u Hrvatskoj koje sudjeluju u natječaju.
4.    Prijavljivanjem za sudjelovanje u Promociji u skladu s ovim Uvjetima, svaki sudionik („Vi”, „Vaš”, „sudionik”) prihvaća da bude vezan ovim Uvjetima i odlukama tvrtke Monster Energy, čije će odluke biti konačne, u odnosu na sva pitanja vezana uz Promociju. Monster Energy neće započinjati nikakvu drugu korespondenciju.
5.    Sva vremena i datumi koji se navode u ovim Uvjetima odnose se na vremena i datume u Hrvatskoj. U slučaju spora oko vremena i datuma bilo koje od podnesenih prijava odluka Monster Energy bit će konačna.
6.    Nikakva kupnja proizvoda nije potrebna da biste se prijavili za ovu Promociju.
Prijava
7.    Datum početka Promocije je 00:01 na 14. veljače 2025.  („Datum početka”) i završetak Promocije je 23:59 na 1. travnja 2025. („Datum završetka”).
8.    Sudionici se mogu prijaviti za Promociju:
A.    djelovanjem sukladno ovim Uvjetima;
B.    podnošenjem njihovih detalja kako upućuje Internetska stranica (koje čine puno ime i prezime, adresa prebivališta, broj telefona, datum rođenja i adresa e-pošte); i
C.    odgovaranjem na sljedeće pitanje (u manje od 30 riječi): „Zašto ste vi najveći ljubitelj natjecanja UFC® ” („Odgovor”).

Nagrada i zahtjevi Nagrade

9.    Svaki sudionik koji valjano podnese svoju prijavu kako je gore navedeno (svaka od njih „Važeća prijava”) unosi se u skup prijava sa svim drugim Važećim prijavama. 
10.    Žiri koji se sastoji od tri (3) predstavnika tvrtke Monster Energy i jednog (1) neovisnog suca (koji čini „Žiri”) surađivat će i u roku od tri (3) dana od Datuma završetka odrediti jednog (1) pobjednika („Pobjednik”) koji je dobitnika nagrade (kako je definirano u nastavku).
11.    Žiri će odrediti Pobjednika na temelju Odgovora koji pokazuje najkreativniji i najoriginalniji odgovor, domišljatost, najbolje razumijevanje Monster Energy®, UFC® te najbolju upotrebu rječnika i stila pisanja („Kriteriji odabira“).
12.    Žiri će osigurati da su prijave valjane u skladu s ovim Uvjetima, ocijeniti Važeće prijave prema Kriterijima odabira i dodijeliti Nagradu Pobjedniku („Postupak odabira“).
13.    Pobjednik će osvojiti putovanje za dvije (2) osobe koje uključuje tri (3) noćenja između 1. lipnja 2025. i 31. prosinca 2025. a točne datume odredit će Monster Energy prema vlastitoj potpunoj diskreciji, a putovanje će uključivati sljedeće („Nagrada”): 
A.    dvije (2) opće pristupne propusnice za jedan (1) događaj UFC® („Događaj”), a svakom će propusnicom nositelju biti zajamčen ulaz na Događaj, pristup svim javnim prostorima na Događaju tijekom razdoblja kada je Događaj otvoren.
B.    tri (3) noćenja za dvije (2) osobe u dvokrevetnoj sobi s najmanje tri (3) zvjezdice; hotel koji će Monster Energy odabrati prema vlastitoj potpunoj diskreciji, što podliježe raspoloživosti („Hotel“)
C.    povratne karte za let ekonomskom klasom za dvije (2) osobe od zračne luke u Hrvatskoj do zračne luke u Sjedinjenim Američkim Državama („Odredišna zračna luka”). Lokacije zračnih luka, datume i vrijeme letova odredit će Monster Energy prema vlastitoj potpunoj diskreciji, što podliježe raspoloživosti
D.    povratne transfere ekonomskom klasom za Pobjednika i Odabranu osobu od Odredišne zračne luke do Hotela te od Hotela do svake aktivnosti, vrijeme, datume i načine prijevoza odredit će Monster Energy prema vlastitoj potpunoj diskreciji, što podliježe raspoloživosti. U svrhu izbjegavanja sumnje, Monster Energy neće osiguravati povratne transfere od Pobjednikove kuće i/ili kuće Odabrane osobe do odabrane zračne luke u Hrvatskoj; ti će transferi biti odgovornost Pobjednika i njegove Odabrane osobe. 
14.    Samo Pobjednik i jedna (1) osoba koju izabere Pobjednik („Izabrana osoba“) mogu uživati u Nagradi. Izabranu osobu mora biti odobriti tvrtke Monster Energy, a ona biti starija od osamnaest (18) godina i imati prebivalište u Hrvatskoj. Pobjednik i Izabrana osoba moraju imati važeće putovnice koje ne istječu prije 31. lipnja 2026. kako bi iskoristili Nagradu.
15.    Prije proglašenja Pobjednika i primanja Nagrade, od potencijalnog Pobjednika i njegove/njezine Izabrane osobe može biti zatraženo da dokažu svoju podobnost, uključujući bez ograničenja, svoju dob, prebivalište i identitet, što uključuje ali se na ograničava samo na, presliku dokaza o prebivalištu, putovnice i/ili slične službene državne identifikacije. Propust da se tvrtki Monster Energy dostave ove informacije u razumnom roku koji je odredila tvrtka Monster Energy mogu rezultirati da Pobjednik bude lišen Nagrade te Monster Energy izabere drugu Važeću prijavu za sudjelovanje što je prije razumno moguće nakon toga.
16.    Od Pobjednika i Izabrane osobe bit će zatraženo da potpišu odricanje koje je pripremila tvrtka Monster Energy, prema vlastitoj apsolutnoj diskreciji, specifično za razumijevanje potvrđivanja Nagrade, sukladno s odricanjem i njegovim prihvaćanjem. Preslike predmetnih potvrda i odricanja mogu se dobiti na zahtjev na www.monsterenergy.com/contact-us.
17.    Radi izbjegavanja dvojbe, sve troškove vezane uz Nagradu, uključujući ali ne ograničavajući se na porez, važeće zdravstveno osiguranje za putovanje, putnu vizu (ako je primjenjivo), prijevoz (uključujući prijevoze između doma/domova Pobjednika i Izabrane osobe i zračne luke), podršku, hranu i svu zabavu i bilo što vezano za Nagradu a nije posebno uključeno i istaknuto u definiciji Nagrade. iznad snosit će isključivo Pobjednik. Smještaj u okviru Nagrade samo je na temelju sobe te će Pobjednik i Izabrana osoba biti odgovorni za svu hranu i piće koje konzumiraju na drugom mjestu a nije posebno uključeno i istaknuto u definiciji Nagrade i sve dodatne troškove za sobu.

Obavijest i isporuka Nagrade
18.    Pobjednik će biti obaviješten e-porukom i/ili telefonom putem adrese e-pošte i/ili broja telefona danim u prijavi za Promociju, u roku od sedam (7)  dana nakon Postupka odabira („Obavijest“). Neuspješni sudionici neće biti obaviješteni.
19.    Detalje o isporuci Nagrade odredit će Monster Energy prema vlastitoj potpunoj diskreciji. Detalji isporuke Nagrade (uključujući ali ne ograničavajući se na vrijeme, datum i mjesto isporuke) bit će navedeni Pobjedniku u Obavijesti.
20.    U slučaju da Monster Energy ne može kontaktirati potencijalnog Pobjednika u roku od tri (3) dana nakon Obavijesti ili da potencijalni Pobjednik ne može preuzeti Nagradu ili da potencijalni Pobjednik ne može sudjelovati u Putovanju iz bilo kojeg razloga, tada će se takvo sudjelovanje smatrati ništavim i neće proizvoditi pravne efekte te će Monster Energy odabrati drugu Važeću prijavu što je prije razumno moguće nakon toga sukladno Postupku odabira.
     Opći uvjeti
21.    Sudionici su ograničeni na jednu (1) prijavu po osobi te svaki sudionik neće podnijeti niti pokušati podnijeti više od jedne (1) prijave. Monster Energy zadržava pravo odbiti prijavu svakog pojedinca za Promociju koji podnese ili pokuša odnijeti više od jedne (1) prijave.
22.    Prijave neće biti važeće ukoliko su učinjene „online“ upotrebom skripta, komandnih datoteka, makronaredbi ili automatiziranih uređaja. Monster Energy zadržava pravo provjere valjanosti unosa i prijava kao i da isključi unose i prijave za koje vjeruje da su bili učinjeni tehnikama automatskih unosa podataka. 
23.    Radi izbjegavanja dvojbe, nužno je osobno računalo ili drugi uređaj spreman za pristup internetu za prijavu za Promociju. Obveza sudionika je da osiguraju da imaju dozvolu vlasnika osobnog računala i pojedinca koji plaća pružatelju pristup internetu. Ne može se tražiti povrat novaca za troškove u svezi s pristupom internetu kao i radi sudjelovanja u ovoj Promociji.
24.    .Sve prijave smatrat će se da su primljene u trenutku unosa istih u bazu podataka tvrtke Monster Energy a ne u trenutku kada je sudionik iste poslao putem Internetske stranice.
25.     U slučaju bilo kakvog spora o identitetu Pobjednika, odluka tvrtke Monster Energy bit će konačna. 
26.    Slanje internetskog formulara za unos podataka ili drugog dokaza u bilo kojem drugom obliku da je  poslan internetski formular za unos podataka ili prijave, nije dokaz da su isti zaprimljeni. Monster Energy ne preuzima nikakvu odgovornost za unose i prijave koji nisu pravilno ispunjeni, koji su zagubljeni ili su kasno zaprimljeni ili koji nisu zaprimljeni iz bilo kojeg razloga.
27.    Nagrada kako je opisana, nije prenosiva, niti zamjenjiva i nikakva alternativa u novčanoj protuvrijednosti nije moguća u slučaju da Pobjednik nije u mogućnosti iz bilo kojeg razloga preuzeti Nagradu. Unatoč prethodno navedenom, u slučaju nepredviđenih okolnosti odnosno ako Monster Energy nije u mogućnosti isporučiti Nagradu zbog pandemije bolesti COVID-19 ili nekog drugog razloga, Monster Energy zadržava pravo zamijeniti Nagradu ili bilo koji njezin dio nagradom iste ili veće vrijednosti.
28.    Pobjednik je suglasan da sudjeluje i osigurat će da Izabrana osoba bude suglasna, ukoliko Monster Energy to zatraži, da sudjeluje u razumnom publicitetu kao rezultat Promocije te Glavni pobjednik i Izabrana osoba potvrđuju da Monster Energy može upotrijebiti njihovo ime i prezime, sliku ili njihove audio i/ili video zapise u javnosti vezano uz Promociju kako je opisano u pravilima o privatnosti podataka tvrtke Monster Energy.
29.    Ako se tvrtka Monster Energy ne pridržava ovih Uvjeta, ona je odgovorna za gubitak ili štetu koje sudionik pretrpi koja je predvidljivi rezultat kršenja  ovih Uvjeta ili nepažnje tvrtke Monster Energy, no nije odgovoran za bilo kakav gubitak ili štetu koji je nisu predvidljivi. Gubitak ili šteta predvidljivi su ako su očigledna posljedica kršenja tvrtke Monster Energy ili ako su ih razmatrali sudionik i Monster Energy u vrijeme kad se sudionik prijavio za Promociju. Osim odgovornosti tvrtke Monster Energy za predvidljivi gubitak ili štetu, Monster Energy i/ili bilo tko od njezinih povezanih tvrtki, zaposlenika, direktora, zastupnika, opunomoćenika ili podugovarača odriče se svih odgovornosti u najvećoj mjeri dopuštenoj zakonom.
30.    Mogu se dogoditi slučajevi koji uzrokuju Promociju ili dodjeljivanje Nagrada nemogućim zbog razloga koji su izvan kontrole tvrtke Monster Energy i sukladno tome, Monster Energy može, prema vlastitoj apsolutnoj diskreciji, prilagoditi ili promijeniti Promociju i/ili dodjeljivanje Nagrade i sudionik/sudionica je suglasan/suglasna da Monster Energy zbog toga neće snositi nikakvu odgovornost.
31.    Monster Energy zadržava pravo da: (a) promijeni format Promocije i/ili odgodi Promociju ili bilo koji dio ili dijelove iste, u cijelosti ili u dijelu zbog razloga koji su izvan kontrole, bez ikakve odgovornosti prema sudioniku; i/ili (b) odbije prijavu osobe za sudjelovanje u Promociju ili u budućim događajima organiziranim od strane tvrtke Monster Energy; (i) kada Monster Energy razumno vjeruje da je Nagrada bila prenesena na treću osobu u cijelosti ili djelomično; (ii) kada je osoba diskvalificirana iz bilo kojega natjecanja koje organizira Monster Energy ili promocije tijekom dvanaest (12) mjeseci nakon Datuma početka; (iii) kada Monster Energy razumno vjeruje da osoba nije postupala u skladu s ovim Uvjetima; i/ili (iv) kada osoba nema uvjete da sudjeluje u Promociji (ili bi sudjelovanje u Promociji trebalo biti odbijeno iz bilo kojeg razloga).
32.    Osim ukoliko nije izričito navedeno u ovim Uvjetima, Monster Energy nema nikakvu odgovornost za troškove ili gubitke koje je možda sudionik pretrpio. Pobjednik će biti odgovoran za plaćanje eventualnog poreza u pogledu Nagrade.  
33.    Preporuča se da svi sudionici zadrže ove Uvjete u slučaju buduće potrebe.
34.    Prihvaćate da vaše ime i prezime mogu biti javno dostupni ako ste Pobjednik. Ime i prezime Pobjednika dostupno je kontaktiranjem s tvrtkom Monster Energy na www.monsterenergy.com/contact-us u roku od 90 dana od Datuma završetka.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                              
35.    Na Promociju i ove Uvjete primjenjuje se pravo Engleske i Walesa koje podliježe obveznim odredbama lokalnog zakonodavstva o zaštiti potrošača koje se može primijeniti na zahtjev u vašu korist putem zakona i ništa u Promociji i ovim Uvjetima ne utječe na vaša prava kao potrošača da se oslanjate na takve obvezne odredbe lokalnog prava.
36.     Bilo koji spor (temeljem ugovora ili izvan ugovora) koji bi mogao proisteći ili koji je u svezi s ovom Promocijom ili ovim Uvjetima bit će u nadležnosti jurisdikcije sudova Engleske i Walesa. Međutim, ovo ne ograničava obvezna prava prema važećem zakonodavstvu o zaštiti potrošača.

38.    UFC®, Ultimate Fighting Championship®, Zuffa®, Octagon® te osmerokutni dizajn podloge za borbu i kaveza registrirani su žigovi, registrirani uslužni žigovi, žigovi, vizualni izgledi i/ili uslužni žigovi u isključivom vlasništvu poduzeća Zuffa, LLC, a licencirani su njegovim povezanim subjektima i drugim nositeljima licencije u Sjedinjenim Američkim Državama i drugim jurisdikcijama. Svi ostali ovdje spomenuti znakovi mogu predstavljati vlasništvo poduzeća Zuffa, LLC, njegovih povezanih društava ili drugih vlasnika.

LONG FORM PROMOTION TERMS & CONDITIONS
Please read these terms & conditions (“Terms”) carefully.  By entering this promotion (the “Promotion”), you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.
1.    The Promotion is being organised and operated by Monster Energy Europe Limited of 7 Cowley Business Park, Cowley, Uxbridge, UB8 2AD, UK (“Monster Energy”).
2.    The Promotion is open to all persons over eighteen (18) years of age and who are resident in Croatia. No employee or family member of an employee of Monster Energy, Zuffa LLC, or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion. 
3.    The Promotion is being conducted through the website at www.monsterenergy.com (the “Website”) and promoted through promotional material within selected participating locations in Croatia.
4.    By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.
5.    All times and dates set out in these Terms refer to the times and dates in Croatia. In the event of any dispute over the time or date of any entry submitted the decision of Monster Energy shall be final.
6.    No purchase of any product is required to enter the Promotion. 
Entry

7.    The commencement date of the Promotion is 00:01 on 14.02.25 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 01.04.25 (“Closing Date”).  
8.    Entrants may enter the Promotion by: 
A.    acting in accordance with these Terms; 
B.    submitting their details as directed on the Website (being full name, residential address, telephone number, date of birth and email address); and
C.    answering the following question (in 30 words or less): “Why are you the number one UFC® fan?” (“Answer”).
Prize & Requirements

9.    Each entrant that validly submits their entry as set out above (each a “Valid Entry”) shall be entered into a pool of entries with every other Valid Entry. 
10.    A panel consisting of three (3) Monster Energy representatives and one (1) independent judge (which makes up the “Panel”) will collaborate and within three (3) days of the Closing Date choose one (1) winner (the “Winner”) of the Prize (as defined below).
11.    The Panel shall determine the Winner based on whose Answer demonstrates the most creative and original response, ingenuity, the best understanding of Monster Energy®, UFC® and the best use of vocabulary and writing style (“Selection Criteria”). 
12.    The Panel shall ensure that the entries are valid in accordance with these Terms, judge the Valid Entries on the Selection Criteria, and assign the Prize to the Winner (the “Selection Process”).  
13.    The Winner shall win a trip for two (2) people for three (3) nights to take place between 01.06.25 and 31.12.25, exact dates to be determined by Monster Energy in its complete discretion (“Trip”), which shall consist of the following (“Prize”):
A.    two (2) general access tickets to one (1) UFC® event (“Event”), each ticket shall grant the holder entrance to the Event; access to all public areas at the Event during the opening hours of the Event;
B.    a three (3) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating; the hotel to be selected by Monster Energy in its complete discretion, subject to availability (“Hotel”);
C.    return economy flight tickets for two (2) people from an airport in Croatia to an airport in the United States of America (“Destination Airport”). The airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion, subject to availability; and
D.    return economy transfers for the Winner and their Elected Person from Destination Airport to Hotel, and Hotel to each activity; the times, dates and mode of transport to be determined by Monster Energy in its complete discretion, subject to availability. For the avoidance of doubt, Monster Energy shall not provide return transfers from the Winner’s home and/or Elected Person’s home to the selected airport in Croatia; this shall be the responsibility of the Winner and their Elected Person.
14.    Only the Winner and one (1) person, as chosen by the Winner (“Elected Person”) may enjoy the benefits of the Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Croatia. The Winner and the Elected Person must hold valid passports that do not expire before 31.06.26 in order to redeem the Prize. 
15.    Before being declared the Winner and receiving the Prize, the potential Winner and the Elected Person may be required to prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/or similar government issued identification. Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Winner forfeiting the Prize and Monster Energy selecting another Valid Entry as soon as reasonably possible thereafter.
16.    The Winner and the Elected Person will be required to sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Prize confirming understanding, compliance with and acceptance of the waiver. Copies of the applicable confirmation and waiver can be obtained upon request from www.monsterenergy.com/contact-us.
17.    For the avoidance of doubt, all costs associated with the Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation (including transfers between the Winner and the Elected Person's home and the airport, accommodation, equipment, sustenance, any entertainment and anything related to the Prize not specifically included and outlined in the definition of the Prize above will be borne solely by the Winner. Accommodation for the Prize is on a room only basis and the Winner and the Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Prize and all additional room charges.

Notification and Prize Delivery

18.    The Winner will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within seven (7) days of the Selection Process (“Notification”). Unsuccessful entrants will not be notified. 
19.    The delivery details of the Prize shall be determined by Monster Energy in its complete discretion. Details of delivery of the Prize (including but not limited to the time, date and location of delivery) shall be provided to the Winner at Notification.
20.    In the event that Monster Energy cannot contact the potential Winner within three (3) days of the Notification, or if the potential Winner is unavailable to retrieve the Prize or the potential Winner is unavailable to attend the Trip for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall select another Valid Entry as soon as reasonably possible thereafter in accordance with the Selection Process. 
General Terms

21.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
22.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
23.    For the avoidance of doubt a computer or another internet ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider. No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
24.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant. 
25.    If there is any dispute as to the identity of the Winner, the decision of Monster Energy shall be final.
26.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received. Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.  
27.    The Prize is as described and not transferable, not exchangeable and no cash alternative will be offered in the event that the Winner is unable to claim the Prize for any reason whatsoever. Notwithstanding the foregoing, in the event of unforeseen circumstances or Monster Energy being unable to deliver the Prize due to the COVID-19 pandemic or for any other reason, Monster Energy reserves the right to replace an entire Prize or prize components with a prize of equal or greater value.
28.    The Winner agrees to participate and shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winner and the Elected Person acknowledge that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
29.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                           
30.    Events may occur that render the Promotion itself or the awarding of the Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
31.    Monster Energy reserves the right to: (a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or (b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
32.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Winner will be liable for any tax chargeable in relation to the Prize.   
33.    It is advised that all entrants retain a copy of these Terms for future reference.
34.    You accept that your name may be made available to the public if you are the Winner. The Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 90 days of the Closing Date.   
35.    The Promotion and these Terms are governed by the laws of England and Wales subject to mandatory provisions of local consumer law that may apply for your benefit by operation of law and nothing in the Promotion and these Terms affect your rights as a consumer to rely on such mandatory provisions of local law.
36.    Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in England and Wales. However, this shall not limit consumers' mandatory rights under the applicable consumer protection legislation.
