TERMINI E CONDIZIONI DELLA PROMOZIONE
Si prega di leggere attentamente i presenti termini e condizioni (le "Condizioni"). Partecipando alla presente promozione (la “Promozione”), l'utente acconsente a essere vincolato dalle presenti Condizioni. Leggere inoltre l'informativa sulla privacy alla pagina www.monsterenergy.com, che spiega il modo in cui vengono utilizzati i dati fornitici quando si partecipa alla Promozione.
1.    La Promozione è organizzata e messa in atto da Monster Energy Europe Limited, con sede a Monster House, 7 Cowley Business Park, High Street, Uxbridge, UB8 2AD, Regno Unito ("Monster Energy"). 
2.    La Promozione è aperta a tutti gli individui che abbiano compiuto il diciottesimo (18) anno di età e che siano residenti in Svizzera. I dipendenti o familiari di dipendenti di Monster Energy o delle sue società affiliate, subappaltatori, agenti o cessionari o chiunque altro professionalmente connesso alla Promozione non possono partecipare alla Promozione.
3.    La Promozione è condotta attraverso il sito Web www.monsterenergy.com (il "Sito Web") e viene promossa tramite il materiale promozionale nelle località partecipanti selezionate in Svizzera (“Rivenditore”).
4.    Partecipando alla Promozione secondo queste Condizioni, ciascun partecipante ("tu/voi", "tuo/vostro", "Partecipante") accetta di essere vincolato dalle presenti Condizioni e dalle decisioni di Monster Energy, che saranno definitive, in relazione a tutte le questioni relative alla Promozione. Monster Energy non parteciperà a ulteriore corrispondenza.
5.    Tutti gli orari e le date indicate nelle presenti Condizioni si riferiscono a orari e date della Svizzera. In caso di controversie relative all'orario o alla data di una partecipazione, la decisione di Monster Energy sarà quella definitiva.
6.    Per partecipare alla Promozione non è richiesto l'acquisto di alcun prodotto.
Partecipazione

7.    La Promozione ha inizio alle ore 00:00 del 15/04/2024 (“Data di inizio”) e termina alle ore 23:59 del 28/06/2024 (“Data di chiusura”).
8.    I partecipanti possono accedere alla Promozione:
8.1    agendo in conformità alle presenti Condizioni; e
8.2    inviando i propri dati come indicato sul Sito Web (nome, cognome, indirizzo di residenza, numero di telefono, data di nascita e indirizzo di posta elettronica).

Premi e requisiti

9.    Ogni partecipante che presenta una partecipazione valida, come indicato sopra (ciascuno, un "Partecipante valido"), sarà inserito in un sorteggio casuale da tenersi entro cinque (5) giorni dalla Data di chiusura ("Estrazione"). 
10.    La prima Partecipazione valida selezionata casualmente tramite l’Estrazione (il "Vincitore") si aggiudicherà un viaggio per due (2) persone per tre (3) notti al MotoGP di Silverstone, nel Regno Unito, fra l’01/08/24 e il 07/08/24 (le date esatte saranno stabilite da Monster Energy, a sua completa discrezione) (“Viaggio”), composto da quanto segue (il “Premio”):
10.1.    due (2) biglietti per le giornate di gara al MotoGP di Silverstone durante il Viaggio (“Evento”). Ciascun biglietto garantirà al possessore l’accesso all’Evento e a tutte le aree pubbliche dell’Evento durante gli orari di apertura dello stesso;
10.2.    tre (3) pernottamenti in camera doppia per due (2) persone in hotel di categoria non inferiore a tre (3) stelle, 
selezionato da Monster Energy, a sua assoluta discrezione, in base alle disponibilità (“Hotel”);
10.3.     biglietti aerei di andata e ritorno per due (2) persone in classe economica da un aeroporto della Svizzera a un aeroporto del Regno Unito selezionato da Monster Energy ("Punto di destinazione"). L'ubicazione degli aeroporti, le date e gli orari dei voli saranno stabiliti da Monster Energy a sua completa discrezione; e
10.4.    trasferimenti di andata e ritorno, stabiliti da Monster Energy a sua assoluta discrezione, per due (2) persone in classe economica dal Punto di destinazione all'Hotel, come stabilito da Monster Energy, a sua assoluta discrezione; gli orari e le modalità di trasporto saranno stabiliti da Monster Energy a sua assoluta discrezione, in base alle disponibilità.
11.    Solo il Vincitore e una (1) persona, selezionata dal Vincitore (la “Persona selezionata”), potranno usufruire dei vantaggi del Premio. La Persona selezionata deve essere approvata da Monster Energy, avere compiuto il diciottesimo (18) anno di età ed essere residente in Svizzera. Per poter riscattare il Premio, il Vincitore e la Persona selezionata devono essere in possesso di un passaporto in corso di validità con scadenza successiva al 28/02/2025.
12.    Prima di essere dichiarato Vincitore e di ricevere il Premio, il potenziale Vincitore e la Persona selezionata potranno essere tenuti a fornire prova della propria idoneità, fra cui, a titolo esemplificativo, prova di età, residenza, identità, tramite, a titolo non esaustivo, una copia di una prova di residenza, passaporto e/o assimilabile documento di identità. Il mancato conferimento a Monster Energy di queste informazioni entro il termine ragionevole stabilito da Monster Energy può comportare la rinuncia del Premio da parte del Vincitore e Monster Energy potrà selezionare un’altra Partecipazione valida non appena ragionevolmente possibile dopo tale data.
13.    Il Vincitore e la Persona selezionata saranno tenuti a firmare una dichiarazione preparata da Monster Energy, a sua completa discrezione, specifica per il Premio, che confermi la comprensione, il rispetto e l'accettazione della stessa. Copie della conferma e della dichiarazione possono essere ottenute su richiesta all'indirizzo www.monsterenergy.com/contact-us.
14.    Il Vincitore e la Persona selezionata saranno tenuti a consultare le indicazioni di viaggio, i requisiti per l’ingresso nel Paese di destinazione e assicurarsi di disporre degli eventuali visti necessari per il viaggio.
15.    A scanso di equivoci, tutti i costi associati al Premio, inclusi, a titolo esemplificativo e non esaustivo, le tasse, un’assicurazione sanitaria valida per il viaggio, il visto per il viaggio (se applicabile), i trasporti (inclusi i trasferimenti dal domicilio del Vincitore e della Persona selezionata all’aeroporto), l’alloggio, l’attrezzatura, il vitto, qualsiasi forma di intrattenimento e tutto ciò che riguarda il Premio che non sia espressamente incluso e delineato nella definizione del Premio sopra riportata, saranno a carico esclusivo del Vincitore. L’alloggio relativo al Premio prevede esclusivamente il pernottamento e il Vincitore e la Persona selezionata dovranno farsi carico dei costi connessi a tutti gli alimenti e le bevande consumati presso l’Hotel o altrove, che non siano specificamente inclusi e indicati nella definizione di Premio, oltre che di tutti gli ulteriori addebiti relativi alla camera. Il Vincitore accetta di sottoscrivere e di rispettare gli eventuali termini e condizioni fornitigli dai relativi fornitori dei servizi per il Premio.
16.    Il Vincitore sarà tenuto a fornire l’eventuale documentazione richiesta e a soddisfare gli eventuali ulteriori requisiti legali relativi al Premio e/o l’eventuale documentazione richiesta dalla legge e/o da Monster Energy.

Notifica e consegna del Premio

17.    Il Vincitore sarà avvisato via e-mail e/o telefonicamente tramite l'indirizzo di posta elettronica e/o il numero di telefono forniti al momento dell'adesione alla Promozione entro sette (7) giorni dall’Estrazione (“Notifica”). I partecipanti non estratti non saranno avvisati.
18.    I dettagli di consegna del Premio saranno stabiliti da Monster Energy, a sua completa discrezione. I dettagli di consegna del Premio (fra cui, a titolo esemplificativo, l’ora, la data e il luogo di consegna) saranno forniti al Vincitore al momento della Notifica.
19.    Qualora Monster Energy non riuscisse a contattare un potenziale Vincitore entro tre (3) giorni dalla Notifica, qualora un potenziale Vincitore non fosse disponibile a ricevere il Premio, ovvero qualora un potenziale Vincitore non potesse partecipare al Premio per qualunque motivo, tale partecipazione sarà ritenuta invalida e Monster Energy sceglierà non appena possibile un’altra Partecipazione valida.

Condizioni generali
20.    I partecipanti possono inviare un massimo di una (1) partecipazione per persona e ogni partecipante non deve inviare o tentare di inviare più di una (1) partecipazione. Monster Energy si riserva il diritto di rifiutare la partecipazione di un individuo alla Promozione, qualora inviasse o tentasse di inviare più di una (1) partecipazione.
21.    Le partecipazioni non saranno valide se vengono effettuate online utilizzando metodi generati da script, macro o dispositivi automatici. Monster Energy si riserva il diritto di verificare la validità delle partecipazioni e di escludere le partecipazioni che ritenga realizzate con qualsiasi tecnica automatizzata.
22.    A scanso di equivoci, per partecipare alla Promozione occorre un computer o altro dispositivo con accesso a Internet e l'accesso a Internet. I partecipanti hanno la responsabilità di ottenere il permesso del proprietario del computer e della persona che sostiene i costi connessi al fornitore di servizi Internet. Non è possibile chiedere rimborsi per le spese legate all'uso di una connessione Internet per partecipare alla Promozione.
23.    Tutte le partecipazioni sono considerate ricevute al momento dell'immissione nel database di Monster Energy e non al momento in cui il partecipante invia la partecipazione sul Sito Web.
24.    In caso di controversie in merito all'identità del Vincitore, la decisione di Monster Energy sarà quella definitiva.
25.    L'invio del modulo di partecipazione online o qualsiasi altro mezzo di prova dell'invio del modulo di partecipazione online non è una prova di ricezione della partecipazione. Monster Energy declina ogni responsabilità per partecipazioni non completate correttamente, perse, in ritardo o non ricevute per qualsiasi motivo.
26.    Il Premio è come descritto, non è trasferibile, non è intercambiabile e non sarà offerta alcuna alternativa in denaro nel caso in cui il Vincitore non sia in grado di rivendicare il proprio Premio per qualunque motivo. In caso di circostanze impreviste o qualora Monster Energy non fosse in grado di consegnare il Premio a causa del COVID-19, Monster Energy si riserva il diritto di sostituire l’intero Premio o componenti del premio con un premio di valore pari o superiore.
27.    Il Vincitore accetta, e farà in modo che la rispettiva Persona selezionata faccia altrettanto, di partecipare a una ragionevole pubblicità derivante dalla Promozione, se richiesto da Monster Energy. Il Vincitore e la Persona selezionata acconsentono all'utilizzo da parte di Monster Energy del proprio nome, di fotografie e registrazioni audio e/o video in qualsiasi pubblicità relativa alla Promozione, come indicato nella politica sulla privacy di Monster Energy.
28.    Qualora Monster Energy non rispettasse le presenti Condizioni, sarà responsabile per le perdite o i danni subiti dai partecipanti che siano il risultato prevedibile della violazione delle presenti Condizioni da parte di Monster Energy o della sua negligenza, ma non sarà responsabile per eventuali perdite o danni non prevedibili. Le perdite o i danni sono prevedibili se sono una conseguenza ovvia della violazione di Monster Energy o se sono stati previsti dal partecipante e da Monster Energy al momento in cui il partecipante ha partecipato alla Promozione. Fatte salve le responsabilità di Monster Energy per perdite o danni prevedibili, Monster Energy e/o le società affiliate, direttori, dipendenti, agenti, cessionari o subappaltatori declinano ogni responsabilità nella misura massima consentita dalla legge.
29.    Potrebbero verificarsi eventi che rendono la Promozione stessa o l'assegnazione del Premio impossibile per motivi al di fuori dal controllo di Monster Energy; di conseguenza, Monster Energy può, a sua assoluta discrezione, variare o modificare la Promozione. Il partecipante solleva Monster Energy dalle responsabilità ivi connesse.
30.    Monster Energy si riserva il diritto di: (a) modificare il formato della Promozione e/o ritardare o rinviare la Promozione o qualsiasi fase della stessa, in tutto o in parte, per motivi indipendenti dalla sua volontà, senza responsabilità verso il partecipante; e/o (b) rifiutare la partecipazione di qualsiasi individuo alla Promozione o a promozioni future organizzate da Monster Energy: (i) laddove Monster Energy ritenga ragionevolmente che il Premio sia stato trasferito a terzi, in tutto o in parte; (ii) laddove un partecipante sia stato squalificato da qualsiasi concorso o promozione Monster Energy nei dodici (12) mesi precedenti la Data di inizio; (iii) laddove Monster Energy ragionevolmente ritenga che tale individuo non abbia rispettato le presenti Condizioni; e/o (iv) laddove tale individuo non possieda i requisiti per partecipare alla Promozione (o se la partecipazione alla Promozione avrebbe dovuto essere respinta per qualsiasi ragione).
31.    Salvo quanto espressamente previsto nelle presenti Condizioni, Monster Energy declina ogni responsabilità per eventuali costi o spese che possono essere sostenuti da qualsiasi partecipante. Il Vincitore sarà responsabile per le eventuali tasse applicabili in relazione al Premio.
32.    Si consiglia a tutti i partecipanti di conservare una copia delle presenti Condizioni per riferimento futuro.
33.    Qualora risultassi Vincitore, accetti che il tuo nome sia reso pubblico. Il nome del Vincitore è disponibile contattando Monster Energy all’indirizzo www.monsterenergy.com/contact-us entro novanta (90) giorni dalla Data di chiusura.
34.    La Promozione e le presenti Condizioni sono regolate dalle leggi della Svizzera.
35.    Eventuali controversie (contrattuali o extracontrattuali) derivanti o connesse alla presente Promozione o alle presenti Condizioni sono soggette alla giurisdizione non esclusiva dei Tribunali della Svizzera.

PROMOTION TERMS & CONDITIONS
Please read these terms & conditions (“Terms”) carefully. By entering this promotion (the “Promotion”), you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.
1.    The Promotion is being organised and operated by Monster Energy Europe Limited of Monster House, 7 Cowley Business Park, High Street, Uxbridge, UB8 2AD, United Kingdom (“Monster Energy”).
2.    The Promotion is open to all persons over eighteen (18) years of age and who are resident in Switzerland. No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion. 
3.    The Promotion is being conducted through the website at www.monsterenergy.com (the “Website”) and promoted through promotional material within selected participating locations in Switzerland (“Retailer”).
4.    By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.
5.    All times and dates set out in these Terms refer to the times and dates in Switzerland. In the event of any dispute over the time or date of any entry submitted the decision of Monster Energy shall be final.
6.    No purchase of any product is required to enter the Promotion. 
Entry

7.    The commencement date of the Promotion is 00:00 on 15.04.2024 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 28.06.2024 (“Closing Date”).  
8.    Entrants may enter the Promotion by: 
8.1.    acting in accordance with these Terms; and
8.2.    submitting their details as directed on the Website (being full name, residential address, telephone number, date of birth and email address).
Prize & Requirements

9.    Each entrant that validly submits their entry as set out above (each a “Valid Entrant”) will be entered into a random prize draw to be held within five (5) days of the Closing Date (“Draw”). 
10.    The first Valid Entry randomly selected from the Draw (the “Winner”) shall win a three (3) night trip for two (2) people to MotoGP Silverstone, United Kingdom between 01.08.24 and 07.08.24, exact dates to be determined by Monster Energy in its complete discretion (“Trip”), which shall consist of the following (“Prize”):
10.1.    two (2) tickets to race days at MotoGP Silverstone during the Trip (“Event”). Each ticket shall grant the holder entrance to the Event and access to all public areas at the Event during the opening hours of the Event;
10.2.    a three (3) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);
10.3.    return economy flight tickets for two (2) people from an airport in Switzerland to an airport in the United Kingdom as selected by Monster Energy (“Destination Point”); the airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion; and
10.4.    return economy transfers as determined by Monster Energy in its absolute discretion for two (2) people from Destination Point to Hotel as determined by Monster Energy in its absolute discretion; the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability.
11.    Only the Winner and one (1) person, as chosen by the Winner (the “Elected Person”), may enjoy the benefits of the Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in Switzerland. The Winner and the Elected Person must hold valid passports that do not expire before 28.02.2025 in order to redeem the Prize. 
12.    Before being declared the Winner and receiving the Prize, a potential Winner and their Elected Person may be required to prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/or similar government issued identification. Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Winner forfeiting their Prize and Monster Energy selecting another Valid Entrant as soon as reasonably possible thereafter.
13.    The Winner and the Elected person will be required to sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Prize confirming understanding, compliance with and acceptance of the waiver. Copies of the applicable confirmation and waiver can be obtained upon request from www.monsterenergy.com/contact-us.
14.    It is the responsibility of the Winner and their Elected Person to check travel advice for the entry requirements of the country they are travelling to and ensure they have arranged for all necessary travel visas.
15.    For the avoidance of doubt, all costs associated with the Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation (including transfers between the Winner and the Elected Person's home(s) and the airport), accommodation, equipment, sustenance, any entertainment and anything related to the Prize not specifically included and outlined in the definition of the Prize above will be borne solely by the Winner. Accommodation for the Prize is on a room only basis and the Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Prize and all additional room charges. The Winner hereby agrees to sign and comply with any terms and conditions provided by the relevant service providers for the Prize.
16.    It is the responsibility of the Winner to provide any required documentation and any other legal requirements for the Prize and/or documentation required by law and/or Monster Energy.  

Notification and Prize Delivery

17.    The Winner will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within seven (7) days of the Draw (“Notification”). Unsuccessful entrants will not be notified.
18.    The delivery details of the Prize shall be determined by Monster Energy in its complete discretion.  Details of delivery of the Prize (including but not limited to the time, date and location of delivery) shall be provided to the Winner at Notification.
19.    In the event that Monster Energy cannot contact a potential Winner within three (3) days of the Notification or a potential Winner is unavailable to retrieve the Prize, or a potential Winner is unavailable to attend the Prize for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall select another Valid Entrant as soon as reasonably possible thereafter.
General Terms

20.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
21.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
22.    For the avoidance of doubt a computer or another internet ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider. No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
23.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant. 
24.    If there is any dispute as to the identity of the Winner the decision of Monster Energy shall be final.
25.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received.  Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.  
26.    The Prize is as described and are not transferable, not exchangeable and no cash alternative will be offered in the event that the Winner is unable to claim the Prize for any reason whatsoever. In the event of unforeseen circumstances or Monster Energy being unable to deliver the Prize due to COVID-19, Monster Energy reserves the right to replace the entire Prize or prize components with a prize of equal or greater value.
27.    The Winner agrees to participate and shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winner and the Elected Person acknowledge that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
28.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.
29.    Events may occur that render the Promotion itself or the awarding of the Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
30.    Monster Energy reserves the right to: (a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or (b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
31.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Winner will be liable for any tax chargeable in relation to the Prize. 
32.    It is advised that all entrants retain a copy of these Terms for future reference.
33.    You accept that your name may be made available to the public if you are the Winner. The Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within ninety (90) days of the Closing Date.
34.    The Promotion and these Terms are governed by the laws of Switzerland.
35.    Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in Switzerland.
